Regular Council Meeting <br />6-17-02 <br />Page 11 <br />or anything but we did establish a situation whereby they contributed to the overall spirit of <br />development in that region in the North Chagrin Commons. At that time we had assured them and <br />residents of the Village that any other "major players" that would be coming into the area would be <br />asked to participate in some way, shape or form with the (I believe the term is ephemeral) the <br />ephemeral development of North Commons; the intangible. So we would be looking for something <br />in the Development Agreement along those lines-where everybody participates in what goes on up <br />there. So, again, I am not looking for a hard fast number or an actual project at this point but we will <br />be wanting to put something like that on the table in the Development Agreement. <br />Mr. Bell said Goldberg Companies is not Progressive Insurance but I can tell you that we've been in <br />business for 50 years. We've built a number of apartment communities in Greater Cleveland, we've <br />built a number of office buildings. I think if you talk to any of the cities in which we reside (save <br />perhaps one right now but that will change, I hope) we'd get a good review. I think that people will <br />say we're good neighbors, we're responsible neighbors. We are a family-owned business we don't <br />build things to sell ever. We build things to own and manage and pass onto our kids. So we need to <br />be good neighbors. You will see us be a good development partner in that regard. <br />Council President Buckholtz said thank you; I think we're ready to take a vote. <br />Mayor Rinker said I want to try to recap a couple of things too, because in addition to Council's <br />consideration and the reviews that have gone on to date by the various organizations, I want to touch <br />upon a number of things really as a recap. I think for those in the audience that are here and those <br />residents, for example those that live on S.O.M. and those that live on Highland Road, I think then if <br />we understand a number of facts that Council has a chance to look at, and I believe in large measure <br />many of these facts have been reviewed in varying degrees by the Planning and Zoning <br />Commission; I think the Board of Appeals has [reviewed] some of them. But I want to discuss them <br />a little bit tonight because I think they are worthwhile--and, why in the long run, I would encourage <br />this Council to approve this plan which is going to require 5 votes of Council to override what the <br />Board of Appeals determined--because that's really a critical issue. First of all, we talked about the <br />Development Agreement and I think it's fair to state, and I ask these of Mr. Bell, that there is a <br />commitment that we will enter into a Development Agreement with the Goldberg Companies (is that <br />correct?) <br />Mr. Bell replied yes, sir. <br />Mayor Rinker said in substance, from our side we recognize that there are a number of details that <br />need to be worked up. I think it's also fair to state that this agreement should have a provision in it <br />that allows both sides in the event there are any material changes down the road that they will agree <br />in good faith to enter into any mutual discussion in order to address those issues. I think in the <br />general sense that's a commitment that you made all along. <br />Mr. Bell replied, all along. <br />Mayor Rinker said one of those issues I think iYs important to understand is that this is something <br />that our Finance Director can explain further but that's Tax Incremental Financing [TIF]. Mayfield <br />Village has learned, much to the satisfaction of all of us, that a very important tool for this <br />11
