Regular Council Meeting <br />6-17-02 <br />Page 13 <br />Mayor Rinker said then, my understanding is that the reason we are looking at a 4story structure (or <br />as Mr. Samac has pointed out, a 21' height variance) is that with a smaller, 4 floor footprint, you <br />have a more marketable item for a higher end user that concurrently accomplishes what we have <br />already talked about tonight that you are putting the building further away; and again, I think it's <br />important to reiterate-we are looking at a structure at this height that is physically further away. <br />That's 260' from a rear property line-and properties that are largely pretty heavily wooded. But, <br />it's farther away. The parking lot itself, correspondingly, is farther away. <br />Mr. Bell said a minimum of 130'. <br />Mayor Rinker said in the more strategic properties, up to 148'. Again, this places the building <br />further away. The Council President and I can state from personal experience, those distances do <br />matter. At the same time, you are achieving a certain high end development. I do want to come <br />back to this because there are some numbers here that everybody in the audience needs to hear. In <br />addition, you are talking about building an interior roadway that effectively meets our specifications <br />as if it were a dedicated road and that you will cover the cost of that not only in this phase but in <br />any phase up to the point that you hit your north property line, with the understanding that we are <br />going to make the connection that links the current North Commons Boulevard. with yours. How <br />it's designed, where it actually-these two-end up, that is subject to discussion and the <br />Development Agreement. In substance, people need to understand that the roadway on your <br />property-you are incurring that cost. Is that correct? <br />Mr. Bell answered yes. <br />Mayor Rinker said in addition, we have talked about in relation to this ovrall development, that your <br />understanding in talking with your architects in looking at the market, that overall (and this is also <br />with our traffic studies-were amended to reflect) that the overall site build-out of the acreage you <br />currently own would be no more than 615,000 square feet. I can tell you from our end, I would <br />recommend that Council would understand that that 615,000 square feet is a ceiling; it's a cap that <br />we will all work with and that that would never change unless both sides mutually agree that there <br />would be any advantage in exceeding that number. And you said you are comfortable with that <br />limitation. <br />Mr. Bell said that was based on some of these restrictions we are discussing now. So, that was the <br />number we came up with. <br />Mayor Rinker said we should also recognize that a waterline has been constructed. That waterline <br />which services the entire Northwest Quadrant of the Village provides (and the Fire Chief can chime <br />in on this) but it gives us a redundancy, set-up, that for the existing construction of Progressive and <br />any other businesses and certainly any high end user is going to expect that we have a better water <br />system in there that also benefits the existing residences in the area. Overall, it improves our ISO <br />rating and reflects a reality that we have a waterline system and that our Development Agreement, <br />Mr. Bell, I believe reflects the fact that you have cooperated and will continue to cooperate in <br />providing this easement, effectively, at a nominal cost in order to effectuate the completion of this <br />water line. <br />13
