Regular Council Meeting <br />8-19-02 . <br />Page 7 <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Consideration of Case Tabled <br />• Consideration of BOA Case No. 2002-7 (D.O. Summers, 6447 Wilson Mills Road; <br />proposed car wash) <br />Council President Buckholtz said this motion is not for consideration of BOA Case No. 2002-7 <br />(D.O. Suriuners, 6447 Wilson Mills Road; proposed car wash). This came from Planning & <br />Zoning. <br />Mr. Marquardt said BOA had approved the variance. <br />Mr. Marquardt, seconded by Mr. Marrie, made a motion to approve the car wash for D.O. <br />Summers (as proposed) at 6447 Wilson Mills. <br />Dr. Parker said I'd like on the record (it's been stated, but for the vote) that the Police Department <br />does not have a problem with this. <br />Lt. Dearden said no. In our meeting with Mr. Goldberg, he was very reassuring and <br />? understanding our concerns and the fact that he would take whatever steps were necessary up to <br />including closing the car wash on an intermittent basis if traffic trying to use it backed up to the <br />roadway. I think it was with that idea along with that line of thinking that at that point he would <br />also be looking for an attendant to try to maintain the traffic coming in. And once it got to the <br />point that it backed up to the street that they would shut down the operation. From the <br />standpoint of allowing more cars in until such time as there was adequate ability to maintain <br />those vehicles in their lot. <br />Mayor Rinker said kind of in line with what Dr. Parker was saying, I would just ask that at least <br />recognize that all the conditions were put on by Planning & Zoning, that the approval here is <br />going to reflect them. In addition to what Lt. Dearden had gone over, there was the muffling <br />device issue, there is no left turn for exiting traffic out of the site and that the hours of operation <br />be the same as the dry cleaning operation itself. I think those were all specified when Planning <br />& Zoning voted. I don't know if there were any others beyond that but just so everyone <br />understands, those were all contingencies. Lt. Dearden said I'm not quite sure what the hours of operation for the dry cleaner are. I had just <br />specified that it was my belief that limiting their hours of operation for the car wash from 8 a.m. <br />to 6 or 7 p.m. would be the most appropriate consideration of the residents that iive across the <br />street. <br />Mr. Marquardt said I think that was stated that they would not keep it open past 7:00. But, I'm <br />not sure that the no left turn was conditional. <br />4
