Regular Council Meeting <br />10-21-02 <br />Page 10 <br />1 <br />C Zoning Appeals with but it's pretty close; we want to tweak it a little bit and we want to bring it <br />~, back and try something that is a little more acceptable to everyone. <br />Council President Buckholtz said, if I may, let me try to restate this and I will defer to the Law <br />Director. You want to withdraw the appeal to the BZA's decision, and then re-approch the BZA <br />with a new and modified plan. <br />Mr. Jiannetti said that is correct. <br />Council President Buckholtz said then I will defer to Joe on the proper procedures. Mr. <br />Diemert? <br />Mr. Diemert said I think it would be appropriate if that's the applicant's position, he has the right <br />to do that and the Council President should just refer it back to BZA for reconsideration of the <br />revised plan and resubmit it to Council. It would not be inappropriate for him to speak to the <br />issue itself because there maybe councilmen that are concerned about that as well as citizens. <br />So, it might not be a bad idea for him to speak to that. That is up to you, Mr. President. <br />Council President Buckholtz said I'm not sure at this point whether it's a total Council <br />position-I mean-I would certainly be in favor of any attempt to re-work this or re-think this. I <br />think that we are all-and we have scheduled a residents' meeting to discuss the overall issue <br />two weeks from tonight which, again, it's a little misleading in there (if I may say so) and I <br />apologize because my name is on this just to the residents who are here that it is a little <br />misleading in of the statements that a 7,000 square foot building will be built. But I think what <br />was more important was we wanted to get this out quick. We've all had numerous <br />conversations, telephone conversations, with members of the community. Again, I see that as a <br />positive thing but it's trying to get all the information on one sheet of paper and get it back to all <br />the residents as quickly as possible, plus picking a date that works for everybody is not an easy <br />thing. So, I'm just kind of flipping to that because we have some work to do on our end, the <br />Village, the people in the Village have definitely - we have requested a hearing with the <br />Columbus Board-and by the way, I'd like to ask [he turned to Law Director Diemert.] <br />Mr. Diemert said there is no update as to the actual hearing date. <br />Council President Buckholtz said we have no control over when Columbus will make this date. <br />So I think that this sort of, it ties into coordinating the velocity at which this whole project <br />moves. I mean, it is an appealing idea to me. Even if you are going back with an amended plan, <br />and if I heard you correctly, going back with what is perceived as the Code plan that we will be <br />discussing at the residents' meeting-in other words if you have the right to build that type of <br />business there but don't have the right to have any variances granted, then you want to make <br />extra sure that the code is exactly as BZA says it is. So we can open it up first for discussion to <br />Council, I think, at this point, or we can open it up to the floor, or you can continue with your <br />presentation or save it whatever. <br />Mr. Jiannetti said I think that's your call. <br />~_ ~ <br />
