PRD Meeting <br />11-25-02 <br />Page 34 <br />Mr. Riter said no, it's done. <br />Council President Buckholtz asked, it's done? <br />Mr. Riter said it's done. <br />Council President Buckholtz said but Council still approves the project? <br />Mrs. Mills and others said yes. <br />Mr. Riter said but they pass a variance <br />Council President Buckholtz said but it doesn't go to the Appeals Board unless they give a <br />negative- <br />Mr. Riter said correct. <br />Mayor Rinker said no, unless the issue involves a variance. Then it goes-- <br />Council President Buckholtz continued-that's what I am saying-the variance- <br />Mr. Riter said no, no, Mayor. Variances are handled by P&Z in Highland Heights. It's only- <br />Council President Buckholtz said I'm talking about here- <br />Mr. Riter said yes, absolutely. I'm saying that model works because you've got people that are <br />deeply involved in the process. <br />Mayor Rinker said that's a hybrid because in other communities like Solon and Shaker, the P&Z <br />is the BZA, it just depends on when they are convening their meeting and what hat they are <br />wearing. That's the same people but they are different roles that they play. They are doing a <br />different procedural function. <br />Council President Buckholtz said that would be kind of funny, though, if P&Z turns them down <br />and then they want to appeal the decision, and they go back before the same Board. <br />Mayor Rinker said no, no. when I am trying to get at is BZA only deals with very specific <br />variance issues so like when Bill is talking about-if someone comes forward with a site plan, <br />and Planning & Zoning is looking at it, the overall, the whole smear, and there are questions <br />about positioning buildings like the number of buildings, density, all dealing with setback issues, <br />that's going to translate into, I'in putting words in Bill's mouth, but you are looking at the <br />mathematics of the setbacks and all those other restrictions as they are set so you don't have to <br />be redundant with some other provisions. Those will lead the discussion to the need for <br />variances. Variances, then, would be reviewed by BZA. <br />
