_~ MINUTES OF A SPECIAL COUNCIL MEETING <br />Mayfield Village <br />December 30, 2002 <br />The Council of Mayfield Village met in Special Session on Monday, December 30, 2002, at <br />8:05 p.m. in the Mayfield Village Community Room. Council President William Buckholtz <br />presided. <br />ROLL CALL: PRESENT: Council President Buckholtz, Mrs. Cinco, Mr. Marquardt, <br />. Mr. Marrie, Mrs. Mills and Mr. Riter <br />ABSENT: Dr. Parker <br />ALSO PRESENT:. Mayor Rinker, Mr. Brett, Ms. Calta, Mr. Hovancsek , Mr. Metzung <br />and Mrs. Roman <br />Mayor Rinker said for the record, first of all, we have convened this special meeting at my <br />request because we have been trying to carry this, literally, to the 11 `~' hour (as we've said before) <br />and as Gerard has commented, even since this noon we've had-and the report back, I think, <br />between Diane and Gerard, they can give us, really, all the updates. But the other thing I wanted <br />to remind everyone is that we've asked for a special meeting really for that purpose-to let <br />people know that we've extended as much opportunity as we could before having to file the <br />~. petitions. We have a lot of sophisticated people out there (owners) for whom filing in and of <br />itself is not a problem but there are other people where I think it is going to be-there is a <br />certain stigma that ean be attached to it because we are filing petitions. Just to remind everyone <br />we're doing it because our contract with O.D.O.T. is such that O.D.O.T. has told us in order to <br />keep to any schedule which would commence with bidding this spring, it is critical that we <br />demonstrate to O.D.O.T.'s satisfaction that we have acquired all these properties-or in the <br />event that we have not had contracts signed that we have filed petitions in Probate Court in the <br />respective counties (most of them are in Cuyahoga; I think there are 2 in Lake County.) We are <br />not in Executive Session but these are, classically, Executive Session matters; they involve real <br />estate and they involve litigation. But again, because we want to try to keep everyone aware of <br />the fact that this project that we've been talking about for so many years is out on the table- <br />that's what we are going to try to do-but I just caution everyone that if there are specifics with <br />some of these individual property owners, that I ask that we just be discreet about those-any <br />comments in that regard. But with that being said, I appreciate that everyone's here and we can <br />work on this timetable. " <br />Council President Buclcholtz said thank you Mayor. And I want to just add to that, at the risk <br />of-one overlapping thing for that just referencing all of Joe Diemert's work, our Law <br />Department's work on this has been great in explaining that this is nothing more than the <br />procedures, the steps of the procedures and I was going to say that too, just as far who-when we <br />identify who's left on that list-that means nothing other than those are being filed-or monies <br />are being filed in escrow and we don't need to get into like why someone's on the list or not on <br />the list (which is basically what you're saying); that would be for another time. <br />
