Special Council Meeting <br />2-24-03 <br />Page 7 <br />? Dr. Parker said so we are sending this out to them on Friday, what if they turn around and back out? <br />Mayor Rinker asked who is they? <br />Dr. Parker replied Falkner. <br />Mayor Rinker said well, okay; leYs take it a step- <br />Council President Buckholtz said I think we have an agreement, don't we? <br />Mayor Rinker said with Falkner; in every one of these the Administration has come to an <br />understanding with the understanding that it has to be ratified by Council. So whatever commitment <br />the Administration makes is subject to Council's approval. That is the understanding we have. Arid <br />we have drafted a number of purchase agreement proposals and have worked out the fundamental <br />details with both Dr. Falkner and with Mr. Zako. With Falkner, it's only been recently because <br />we've been courting him for months now. He's gone back and forth. He's paying attention to Judge <br />Krenzler's proposal as far as cluster, the PDR that we had; he's paid attention to all the things that <br />Dr. Falkner was shopping the property to Lloyd Chapman. So, he's come in and out of the picture <br />from time to time. But probably the last 6 months, I would say, courted him to get this thing nailed <br />down. We finally, 2 weeks ago, got an agreement with them where he would agree after he talked <br />with his financial advisor and said look, we could break it up in 3 years; that's something that came <br />? from us. We said the more we could break it up, the more we could budget, the better we like it and <br />? we think that you have a strategy that you could pursue your tax advisor with your accountant that <br />this is something that lends itself to your being able to break it up and donate land because it's going <br />to be put to a public park purpose. It's going to be for a public use. And he liked that idea. And we <br />have worked out that proposal. He has been made aware that we are looking at Issue One but we've <br />never said that this is dependent, that the agreement with him depends on Issue One. We'ye always <br />said the agreement is dependent on whether Council supports an agreement period. But he's had the <br />representation from the Administration that this is what we want to do. So he's assuming that <br />barring some unforeseen circumstance, Council will go ahead with it. <br />Dr. Parker asked, so he can't back out on us is what I'm asking? <br />Mayor Rinker said he can always back out on us; it ain't over `til it's over. He could cliange his <br />mind. <br />Dr. Parker said that's my- <br />Mayor Rinker said but he doesn't do it until we have an agreement. We don't have an agreement <br />until Council says we have an agreement. <br />Dr. Parker said so if we get the funding and everything goes along but he decides to back out--- <br />Mr. Brett said no, we'll have a- <br />,'
