Regular Council Meeting <br />4-21-03 <br />Page 7 <br />Council President Buckholtz said it's not listed on here; I don't see it but it is from time to time. <br />That was explained to me my first week on Council. <br />Mr. Diemert said an emergency doesn't mean an emergency in the common sense that you <br />understand it to mean, it just means that it doesn't have to wait 30 days after the Mayor's <br />signature to become law. This particular ordinance is not done as an emergency so it will not go <br />into effect after the Mayor signs it. Most other legislation is because we don't leave that 30 day <br />gap period. Like if you buy salt and you've got a quote, there's no sense waiting 30 days so you <br />pass it as an emergency which means it goes into effect as soon as the Mayor signs it. This one <br />we left open. <br />A member of the audience said I should've asked this before and it may be a silly question but <br />does eminent domain enter into this building of these lots on Ridgebury? One guy could mess <br />up the whole deal. Is there any possibility that that might happen or are the people aware that <br />that might happen? If they vote favorably on development of this thing, do you think eminent <br />domain might enter into kind of forcing these people to se11375' in the back? <br />Council President Buckholtz asked, you are talking about the Mayfield Heights? <br />The member of the audience said the Mayfield Heights development. <br />Mr. Diemert said no, eminent domain will not play into effect. You can't use eminent domain <br />for the assistance to a private developer unless there is some public purpose and there would be <br />none there. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Ordinance Enacted <br />Council President Buckholtz said thanks to all who contributed to this laborious task of crafting <br />this ordinance. <br />OPEN PORTION - 3-minute limit imposed by Chair. Those who wish to speak must first <br />state their name and address. This open portion is limited to discussion pertaining to the items <br />under "Old Business" only. <br />Mr. Tony Fiorelli of Highland Road - said my question is, has the real intention of the Village <br />been said as to why we are acquiring the various properties? Why is the Village buying up land? <br />Has the real intention been noted to the people in the Village? Does everybody in the Village <br />know why you are buying land and what is the overall intention of the Village to buy the land? <br />Council President Buckholtz said I could start with a fairly novice answer. I'm not sure we <br />always know why we're buying land. We are buying strategic pieces of land that could fall into <br />the hands of other developers or other interested parties and when we see the opportunity as has <br />come up several times in the past. If we hold the land, we have the first right to incorporate it
