Regular Council Meeting 4-21-03 Page 7 Council President Buckholtz said it's not listed on here; I don't see it but it is from time to time. That was explained to me my first week on Council. Mr. Diemert said an emergency doesn't mean an emergency in the common sense that you understand it to mean, it just means that it doesn't have to wait 30 days after the Mayor's signature to become law. This particular ordinance is not done as an emergency so it will not go into effect after the Mayor signs it. Most other legislation is because we don't leave that 30 day gap period. Like if you buy salt and you've got a quote, there's no sense waiting 30 days so you pass it as an emergency which means it goes into effect as soon as the Mayor signs it. This one we left open. A member of the audience said I should've asked this before and it may be a silly question but does eminent domain enter into this building of these lots on Ridgebury? One guy could mess up the whole deal. Is there any possibility that that might happen or are the people aware that that might happen? If they vote favorably on development of this thing, do you think eminent domain might enter into kind of forcing these people to se11375' in the back? Council President Buckholtz asked, you are talking about the Mayfield Heights? The member of the audience said the Mayfield Heights development. Mr. Diemert said no, eminent domain will not play into effect. You can't use eminent domain for the assistance to a private developer unless there is some public purpose and there would be none there. Mr. Tony Fiorelli of Highland Road - said my question is, has the real intention of the Village been said as to why we are acquiring the various properties? Why is the Village buying up land? Has the real intention been noted to the people in the Village? Does everybody in the Village know why you are buying land and what is the overall intention of the Village to buy the land? Council President Buckholtz said I could start with a fairly novice answer. I'm not sure we always know why we're buying land. We are buying strategic pieces of land that could fall into the hands of other developers or other interested parties and when we see the opportunity as has come up several times in the past. If we hold the land, we have the first right to incorporate it
