Public Hearing <br />4-21-03 <br />Page 4 <br />Further toward the end of this proposed classification on page 11, we come into Section J that <br />talks about equivalency considerations. This is a section in this chapter that provides the <br />Planning Commission to have a little bit of flexibility in certain cases to find equivalent <br />considerations when topography and other issues prohibit the letter of the ordinance being <br />followed because of those reasons. It gives them a little flexibility and allows for Planning <br />Commission to approve such. <br />The last paragraph of page 11 talks about approval of Village Council. It is the duty of Village <br />Council to review not onlv the preliminarv but the preliminary and final development plans that <br />are submitted to it from Planning Commission for approval before any type of development of <br />this sort can start. <br />On the last page, it talks about the zone district map. This is simply pretty much a housekeeping <br />thing and if this new zone classification is passed by Council then provisions are made in our <br />district and zone map to accommodate this type of zone classification. Again and just to reiterate <br />what Mr. Diemert had said, sometimes there is a little misunderstanding on what this does mean. <br />Again, it does not mean that anv parcel of land in Mayfield Village will be zoned to this <br />classification or be permitted under these regulations until such time as it is submitted and <br />approved by the electorate of the Village and then meet the requirements of this section. That's <br />all I have. I would be happy to answer any questions. <br />Council President Buckholtz asked if there were any questions from the Council floor. We have <br />been over this a number of times. He thanked Mr. Diemert and Mr. Samac for their presentation. <br />At this point we'd like to open it up to the floor. We'd just ask that one at a time you'd approach <br />the podium and the microphone and give your name, address and comments. Your comments <br />and questions will be records and hopefully answered here tonight. Thank you. <br />Dr. Karfes, 6775 I3ickorv Hill Drive - I've lived in the Village for 35 years. Can you give me <br />an example of where this might be demonstrated or performed? Where in the Village is there an <br />example of what this might do or where it would be done? Would you do it on my street-on <br />Hickory Hill; you said no. Where in the Village can you give us an example of how this <br />manipulation would take place? <br />Mr. Samac replied yes, sir. It would not take place on Hickory Hill; that is a residential street. <br />The areas would be S.O.M. Center, Wilson Mills Road, in particular I expect that if this :zone <br />classification is passed that we'll shortly receive applications to consider rezoning property on <br />S.O.M. Center Road, easily identified as the bottom of the dip. On the west side of the street, <br />there's in excess of 6 acres or a little less that I am sure will be requested to be rezoned to this <br />classification to allow this cluster-type or this Planned Residential Development to go in. There <br />are some other locations along both S.O.M. Center Road that I can think of-one being directly <br />across the street that may be conducive to type development. Interest was expressed by a <br />property owner who has property at the northwest corner of Highland Road and S.O.M. Center <br />Road. For the record, the minimum requirements for acreage exceed his area.
