Minutes of the Regular Meeting of Council <br />Monday, April 17, 2017 <br />Page 4 <br />- Open discussion - Permanent Moratorium -1VledicallVlarijuana Faeilitaes <br />Council President Saponaro stated, we had a discussion on this at our Caucus and at the prior <br />Council ineeting in March. I put out to the public that I wanted people to come and talk about it <br />because we want to make sure that everyone's voice is being heard. I am happy if people coine up <br />and talk about it. If there's anyone in the audience who would like to come up and address <br />Council with their thoughts, please state your name and address and provide us with your insight. <br />John Michalko <br />6852 Wilson Mills <br />After the last Caucus meeting, I talked to a lot of neighbors and friends that live in the Village. <br />They totally 100% support what Chief Edelman said about not wanting to have any type of <br />marijuana sales within the Village boundaries. They said let's leave the vote to the safety services <br />that have to handle this, but I know Council makes the final decision, but at this point in tiine, <br />there isn't a person that I talked to that would like to see this brought to the Village. They say <br />there is basically no room for it. Thank you. <br />David Hoehnen <br />750 Robley Lane <br />I would like to offer an alternative point of view to my friend John. I am a current victim of <br />cancer. I have been on chemotherapy since December 9, 2016. I can't tell you how many days in <br />the last five months that I wish there had been a local convenient dispensary of inedical marijuana <br />to relieve the serious side effects of what I am going through right now with chemotherapy. The <br />most significant one is nausea. It has been proven beyond a doubt that medical marijuana either <br />alleviates or prevents nausea from the treatinents that I am receiving. Luckily for me I only have <br />three more treatments to go. But there are other people in this Village I am sure who have cancer <br />or have friends who have cancer. I think it would be helpful to have a local convenient dispensary <br />available to those people. I am only talking about medical marijuana, not social recreational <br />marijuana. Now as far as the production of marijuana, that's a different matter altogether. <br />Another problem I see with this ordinance is that it is a permanent moratorium that prohibits the <br />production, the retail. If every community in this State were to adopt such an ordinance, there <br />would be no medical marijuana at all in Ohio. That would bring up the issue of State pre-emption. <br />I am sure the State would step in and say that these ordinance are illegal under State pre-emption <br />laws. It is simply not legal for all communities to adopt such an ordinance. I am not saying they <br />will, but theoretically, there could be a State pre-emption. And if a significant number of localities <br />adopt these ordinances, I think State pre-emption would be invoked.
