Minutes of the Regular Meeting of Council <br />Monday, July 24, 2017 <br />Page 13 <br />Mr. Marrie replied, thank you. <br />Council President Saponaro stated, thank you. Any other coininents? <br />Dr. Parker stated, on the signs, the problem we have also is that this size would apply to what <br />other, obviously I agree, and I am for a smaller sign from what I am seeing here. But a 3 x 3 <br />sign, we have to be unifonn. Therein lies the problem. <br />Mr. Marrelli stated, that's the idea. To be uniform. <br />Dr. Parker asked, who else is using the large sign that is 3 x 3? <br />Mr. Marrelli replied, I have no idea. <br />Mr. Guidetti replied, the court decision is so recent, I don't think a lot of municipalities have had <br />the chance to make these decisions yet to unify their code. <br />Dr. Parker asked; what would be an example? Who would you see using that sign? <br />Council President Saponaro asked, in a commercial context? <br />Dr. Parker replied, in a coirunercial context. <br />Mr. Marrelli replied, construction. How big was our sign for The Grove? <br />Ms. Wolgamuth replied, 4 x 8. <br />Mr. Marrelli stated, 4 x 8, a lot bigger than that. But that's commercial. That's construction. <br />That's development. There's a whole other standard for that. <br />Council President Saponaro asked, so you are trying to make it uniform from a residential side, <br />not commercial? <br />Mr. Marrelli replied, when we looked at the political sign ordinance and Mark and I discussed it, <br />there was a Court case in Garfield that went to Federal Court. We went all through this issue <br />with discrimination. <br />Mr. Guidetti stated, what the court case focused on, there was a distinction between political <br />signage and then signage placed up on residential properties essentially. The court said, you <br />can't rationally distinguish between allowing only `x' square footage for a political sign and <br />allowing regular lesser footage for a non-political sign. The ruling was a little more expansive so <br />now we are changing our Code to make that adaptation.
