Minutes of the Regular Meeting of Council <br />Monday, September 25, 2017 <br />Page 3 <br />With that, I just wanted to read the plaque I have with me. It says: "Cuyahoga County <br />recognizes the hard work and commitment Mayfield Village .has made to emergency <br />preparedness for the safety and well-being of its citizens. It is a great honor to the community." <br />It is signed by Cuyahoga County Executive Armond Budish and Director of Public Safety <br />Brandy Carney. <br />Council President Saponaro stated, very good. Thank you. <br />Mayor Bodnar asked, Gino, would you like to come up and accept? Thank you very much. We <br />appreciate this. <br />Council President Saponaro stated, congratulations to our Village, especially our Chiefs for a job <br />well done. Thank you, Mr. Christie. We appreciate you coming and bestowing this honor upon <br />us. <br />PUBLIC HEARING: <br />- Proposed Ordinance 2017-31: Affirming the grant of a use variance by the <br />Board of Appeals for a memory care facility on North Commons Boulevard <br />(P.P. No. 831-05-015). <br />Council President Saponaro stated, you are welcome to come up to the podium. You have 5 <br />minutes. Please provide your name and your address and provide your comment regarding this <br />proposed Ordinance. <br />Sheldon Berns <br />I am here tonight representing Artis Senior Living and East Coinmons Limited pursuant to their <br />application for a use variance which as you know was approved unanimously on July 6t1i. of this <br />year by the Zoning Board of Appeals and was recommended unanimously on August 7ffi of this <br />year to Council by the Planning and Zoning Commission. That's a good way to begin. <br />The property, which is owned by East Commons Limited and is under contract to purchase by <br />Artis, consists of two parcels, one of which is approximately one-acre parcel with frontage on <br />SOM Center Road which is restricted and cannot be used for construction or for access to SOM <br />Center Road. The larger parcel containing 4.8 acres is west of the one-acre parcel which will <br />contain a memory care facility to be owned and operated by Artis. The property is located at the <br />north end. Michael Gatto obtained an option to purchase the property from Costanzo's company <br />in early 2010 with the intention of using it for a medical office facility because of changes in the <br />office market, and particularly, the medical office market. <br />The use variance is requested to permit the 4.8 acre parcel to be used for a memory care facility <br />and while the Village employs a practical difficulty test in determining whether it is appropriate <br />to grant this use variance, the evidence before the Board of Zoning Appeals and that which you <br />will receive tonight will demonstrate that there is not only practical difficulty in using the
