Minutes of the Regular Meeting of Council <br />Monday, November 20, 2017 <br />Page 2 <br />Charmaine Rudv <br />1070 Washington Extension <br />This is a small street and Mayfield recently fixed it up. Everyone I ever met at Mayfield is <br />professional. But if the opposition lawyer was correct, someone in the past at Mayfield was careless. <br />It was trivial I am sure to him, but it took a big effort on my part to fix it up. If I am allowed, I want <br />to tell the story quickly. <br />Council President Saponaro stated, I am not following what you are saying yet, so go ahead. <br />In 1999, I noticed my neighbors built a retaining wall and it drained water into my yard. Mayfield <br />attempted to fix it and put the water into a pipe along that wa11. In 2013, I did a survey that showed <br />the underground pipe and the overground pipe were wrong and the water discharged into my yard. <br />Mayfield said they couldn't help and the Councilman that I e-mailed and called never answered me. <br />So I found a lawyer who wrote a letter and suggested move the pipe now and when you rebuild it <br />move the wall there. The other lawyer said Mayfield gave them pernussion to put the wall there, so <br />too bad for me. So my lawyer said I have to take Mayfield and my neighbor to court which was too <br />excessive. I didn't do anything. But last year, it's 21 years almost, so I found another lawyer and <br />those two lawyers met with the Magistrate and they decided to give my neighbors an easement. <br />Well, I said, it's not right. It's too hard on me to give people an easement who were careless and <br />Mayfield said they could be careless. So this year I found a real estate lawyer and he worked out a <br />deal that was fair. Papers were signed. Dea1 is done. But my questions are, whoever these people <br />were, why didn't they make sure before the plans even were off the paper that there was proper storm <br />drainage and how could if that other neighbor was correct, how could Mayfield tell my neighbor that <br />they could build their wall into my yard? That's my story. Besides that, I am real happy with <br />Mayfield. I tlunk it's a great place. <br />Council President Saponaro stated, thank you.
