Minutes of the Regular 1Vleeting of Council
Monday, November 20, 2017
Page 4
Parks and Recreation - Last week, we had a Recreation Board and Activities
Committee meeting. We discussed merging the Recreation Board and Activities Committee. We asked for a vote of opinion and everyone voted in the direction to do it
for 2018 and see how that goes. They will pick and choose the three different entities,
either prograinming, special events or cultural arts and entertainment and then they will
sit on those subcommittees who would then report to the Recreation Board moving
forward. Next Tuesday at 7:00 p.m. in Reserve Hall, the Cleveland Institute of Music
will be performing their Christmas concert. It is a free event. Coming up on December
3rd we have the Tree Lighting Ceremony and then on December 8h we have the Holiday
Movie which will be Polar Express. It will also be in Reserve Hall. We have about 60
people already signed up for that event. On December 9ffi, we have the Santa Ride and
Party followed by December 12'h, the Menorah Lighting.
Joseph W. Diemert, Jr. (Law Department) - I am pleased to announce this past week that the
case involving our insurance company was resolved in our favor. If you recall, Westchester
Insurance insured Skoda in the flooding that occurred. They paid hundreds of thousands of
dollars in damages and then they came after the Village on the basis that we breached a contract
having to do with the weir plate and the drainage going behind into the Service Department
property. Our own insurance company, instead of defending us, intervened in the case and asked
the Court to declare judgment in their favor that they did not need to defend us because coverage
was excluded under one of the exclusions within the policy. I reported this to you when it first
happened. We filed motions for summary judgment and the Judge just ruled this past week that
the Selective Insurance policy does not exclude us from coverage. We are entitled to coverage.
They are ordered to provide that coverage to us. He also found that the Westchester claim is a
contract claim and therefore the insurance company has to defend that claim as well and to
resolve and indeinnify the Village for any damages that might be there. This will probably be
appealed. We will keep you posted on how that goes.
Committee Reports•
Activities Committee - Mr. Jerome - As of now Activities Committee is no more but as Shane
mentioned before, most of the members of the Activities Committee attended the Parks and
Recreation Board meeting and are in favor of inerging the two and using this year with Shane's
advice of having subcommittees moving forward to better serve the residents and to have a better
pool of volunteers. I think it should work out. I was worried about Activities Committee
members who have been there a long time, but this makes a little more sense. It should work. I
am happy to report that everyone seems to be on the same page with it.
Citizen's Advisory - Mrs. 1Vlills - We met on October 30th at the Historical House. Chief
Carcioppolo was our guest speaker which was very informative. Our next meeting is tomorrow
night, the 21St. It is a guided tour at the Vocation Center at the Senior High School on Wilson
Mills at 7:00 p.m. Everyone is invited to that. They are going to have refreshments.
Finance Committee - Mr. Saponaro - There were three items on the agenda for this evening.
All items have been approved and are on the agenda for Council's consideration this evening.
