P & Z Minutes <br />Feb 5, 2018 <br />Pg #4 <br />body at our first workshop meeting has been in direct contact with him all week. He is not <br />willing to sign at this point. I would appreciate if this board would look at the Agreement we <br />presented him. We've been very consistent all along about what we were willing to do in Mr. <br />Kinnaird's backyard. That was presented at all the board meetings that we've come before, the <br />various boards of Mayfield Village. We've actually been through the Board of Zoning Appeals <br />3 times, two on our own behalf and once when the Village asked us to make accommodations <br />on our site plan. We've had that landscape plan professionally designed, professionally costed, <br />it came up to $5,300.00. Mr. Kinnaird had a different set of ideas, so we offered him <br />$10,000.00. In that spread, there's plenty of money to build the mounds that he keeps insisting <br />upon. In negotiations this past week with Mr. Hicks and Mr. Kinnaird directly, we were willing <br />to increase that to $11,000.00 which is twice what we thought was a reasonable <br />accommodation. That's in addition to the fact there's 30 feet of woods, an 8' fence, no bleed <br />lighting regulations so no lighting will bleed onto his property and all storm water from our <br />property will be held on site. We think we've met the zoning criteria that accommodates and <br />respects his property. We tried to make every effort to go over and above that as was requested <br />of us at the very beginning of this process to make improvements in his yard. We're hoping that <br />this week he will sign the Agreement. I reiterate, his expectations I think are well beyond what <br />is reasonable and we made every effort to make a reasonable offer and then essentially double <br />it. I know Chairman Syracuse yon emphasized this was something you wanted to see by <br />tonight's meeting, we tried to do that. It takes two parties to come to an agreement. I <br />respectfully ask you to take that into consideration. <br />Chairman Syracuse asked Mr. Marrelli, have you seen the Agreement, do you have any <br />comment? <br />Mr. Marrelli replied, I haven't seen the Ageement (a copy has since been received). I did talk <br />to Mr. Kinnaird today. He said that the plan wasn't sufficient in his estimation that would allow <br />him enough money to get the mounds built and enough tree cover to block out their building in <br />his backyard according to his estimation. He reiterated that he's trying to get a landscape <br />designer to put together a plan of sorts and he's not sure how much that's going to cost. <br />Apparently he doesn't feel that $10,000 or $11,000 is going to be enough to haul in all the dirt <br />he needs and all the cost of the evergreen. <br />Chairman Syracuse asked, wasn't there talk at one of the meetings about using the dirt from the <br />site? <br />Thomas Jones replied, we don't know what's going to happen in the field when we're <br />developing the site. We've told him verbally we could make accommodations to collect the dirt <br />in the field. But, on paper we can't promise something that we're not sure we can deliver. I'd <br />like to reiterate, I think the word reasonable needs to be examined. I can't build him TPC Golf <br />Course mounds in his backyard, that's beyond reasonable. The landscape plans that we agreed <br />to with him in his backyard from the very beginning has been presented at every meeting. He <br />never made any direct objections and he was asked direct questions regarding his thoughts on <br />the impact of our facility in comparison to the former plan which had 5 office buildings and <br />parking lots pretty much up to his property line.
