activities may be readi!y identlfiable and auditable. The STATE reserves the right to.audit <br />the account or group of accounts: both during and after completion of the PROGRAM. The <br />accounting system must provide a timefy and accu[ate record of transactions. The system <br />should praduce reports that show fund receipts and disbursements, the expended and <br />unexpended balance of each category item, and the total unexpended balance. All <br />supporting documents such as contracts for services, invoices,, personnef time sheets, and <br />mileage reports must be retained for a minimum of 3 years frorri the grant closeout date. <br />B. The GRANTEE agrees to submit a complete and accurate accounting of expenditures and <br />activities under this Agreement to the Division of Parks & Watercraft wifhin 30 days after <br />cumpletion of the baating safefy education PROGRAM. Should the contract be of longer <br />fhan ane year in duration, the GRANTEE agrees to submit a year-end expenditure and <br />activity report far each year the contrac# is .in effect. If any portion of the grant, as above <br />specified, remains unexpended at the complet'ion of the PROGRAM, or'if an audit discloses <br />an unauthoriaed expenditure.of STATf funds, said balance shall be returned by the . <br />GRANTEE to the 3TATE for redeposit in the Waterways Safety Fund immediately upon <br />receipt of invoice #rom the STATE. 9. Funds.for the STATE'S obligation for this PROGRAM shell be released to the GRANTEE <br />after the;execution of an,Agreemen#._between the,STATE.,a?id thp.GRA,NTEE,..No money.will .. . <br />be made available:prior.to the full execution of this Agreement. The GRANTEE shall?not <br />make expenditures for items pertaining to this education grant, elther with grant money or <br />cost share funds, until notifed by the STATE ta proceed. The STATE shall not be <br />responsible for any cost ineurred by the GRANTEE prior to the GRANTEE being natffied in <br />writing to proceed. 10: The STATE requires approval of afl scripts, personnel, and afl other program or project <br />related parameters. in addition, the STATE may use all artwork, photography, texts, or other <br />materials and ideas deveioped in association with the grant. <br />11. All non-expendable equipment items and printed materials purchased directly with grant <br />moneys must be permanently marked with the following (or words to the same effect): <br />"Funded through e grant.from the Ohio Department of Natural Resources, Division of Parks <br />& Watercraft..,." . <br />12. Insurance coverage on equipment purchased through this grant is mandatory. All non- . <br />expendable equipment items must be insured for their replacement vaiue for the life span of <br />the equipment as outiined in Exhibit C. The STATE must be nofified by the GRANTEE in <br />writing 60 days prior to the termination of any coverage. Equipment that has been stolen or <br />lost must be reported to the Division of Parks & Watercraft immediately and replaced with <br />prior written approval from the STATE. <br />13. The parties hereto agree that in the event the STATE, acting through the Chief of the <br />Division of Parks & Watercraft, determines that the GRANTEE has failed to comply with any <br />terms and conditions of the Agreement, the STATE may at such time terminate this <br />Agreement by sending written notice flf such termination and the reasons therefore to the <br />GRANTEE. Upon such termination, the GRANTEE shall immediately return to the STATE <br />any and all moneys contributed by the STATE under the terms of this Agreement which <br />have not as of the date of the termination been legitimately expended by the GRAiV7EE. If <br />at any time, the S7A7E determines that the GRANTEE has made fraudulent expenditures <br />with PROGRAM funds, the STATE reserves the right to demand and receive full repayment <br />of the entire grant amount awarded to the GRANl'EE. <br />14. Termination of the PROGRAM before its completian as originally proposed by the <br />GRANTEE entitles the STATE to reimbursement of the STATE contribution at a prorated <br />amount for non-expendable boating equipment and supplies purchased under this . <br />Agreement. This prorated amaunt depends on the durat+on af the PROGRAM as outlined in <br />2
