Minutes of the Special Meeting of Council Monday, June 4, 2018 . <br />Page 15 <br />Coyne said, we casl ?separately decide, hey, I don't want.it and that's our purview, but <br />when we sit in these chairs, all we are doing is "either saying, did they ineet. the <br />requireinents and should we have allowed tlus to, go on the ballot or not and go to the <br />people?. You all should have the vote. Not us. <br />Mr. McDowell asked, I guess specifically, what would be the requirements in putting it <br />on the ballot? Mr. Coyne replied, if Council votes at the next meeting to put it on the ballot, it would be <br />certified through the Clerk and placed on the ballot in November. <br />Mr. McDowell asked; what measures will you guys use to determine whether or not to <br />put it on the ballot? - <br />Mr. Coyne replied, first of all, I.tlunk the Council is listening to the members of the <br />community here tonight. . Council President:Saponaro stated, this is. one of the requirements. <br />Mr. Coyne stated; it is also a residential use classification in a residential area of the <br />Village. The zoning code you mentioned has been, in effect for a number of years. In <br />2003 actually I think it was first passed. It was amended again in 2006. That was done <br />in a way that the Council saw that it was appropriate to have tliose use- classificatioris. <br />Clearly tliere were prior hearings when.many of us weren't here a dozen or so years ago: <br />This use classification: was adopted by the Village as one of the use classifications in a. <br />residential area appropriate. <br />Any property owner can come in here, at least a dozen from U-1 to U-7 plus subsections . <br />therein; can come and ask that their property be rezoned througli those use classifications. <br />The process is uniformly followed. You go to the Planning Commission and if Plannirig <br />Commission approves. it it then gets referred to Council and Council takes appropriate <br />action after thuee readings and after haviiig a public hearing. But it's important to <br />` <br />remember once the zoning changes, the applicant still has to follow all of the regulatory, <br />provisions in the Code. I think that's very,important. The Village will do that: <br />There are thiiigs in this kind of use elassification that are a little bit unusual. I think theyare unusual and perceived as a positive way. The homeowner's association; for example, <br />is.requ'ired, in fact a maintenance free community is required and tliose are things that can <br />be reyiewed by the Planning Commission and the Council. Also, as Law Director, some <br />of those legal agreeinents can be reviewed. If Plaivling Commission and Council wants, <br />the Law Director to ieview the homeowner's association documents, we can do tliat. I <br />don't remember who spoke, : I think it was Mrs. Fabrizio,.but the provision about the <br />every other year inspection for the Fire Department is probably. in tlie homeowner's <br />associatioil documents. That's not required but those kinds of things cail be required if <br />you have an HOA. 1f you build single-family residences in a standard subdivision, that <br />typically isn't done.
