Minutes of the Regular Meeting of Council Monday, February 25, 2019 Page 13 • First Reading of Ordinance No. 2019-06, entitled, "An Ordinance amending Codified Ordinance Section 337.27 drivers and passengers required to wear seatbelts." Introduced by Mayor Bodnar. (Law Department) Council President Saponaro asked, any questions? The seatbelt law is currently a secondary offense. This would make it a first offense. The police would have the opportunity to stop people for not wearing their seatbelts as a first offense, in a nutshell, Mr. Coyne? Mr. Coyne replied, yes. Council President Saponaro stated, okay. Any other questions on this? There were none. Ordinance No. 2019-06 moved to Second Read. • First Reading of Ordinance No. 2019-07, entitled, "An Ordinance repealing and replacing Codified Ordinance Section 331.43 relating to cell phone use while driving." Introduced by Mayor Bodnar. (Law Department) Council President Saponaro asked, any questions? This would make it a primary offense to be using your cellphone or texting while driving. There are some exceptions for emergency situations which are set forth in the proposed ordinance. Did I state that correctly? Mr. Coyne replied, yes. Council President Saponaro asked, does anyone have any questions on this? There were none. Ordinance No. 2019-07 moved to Second Read. • First Reading of Ordinance No. 2019-08, entitled, "An Ordinance repealing Codified Ordinance Section 331.44 electronic wireless communication device while driving prohibited." Introduced by Mayor Bodnar. (Law Department) Mr. Coyne stated, this is related because of the terminology used to modernize it. We are now focusing on wireless handsets that are used for text messaging or other forms of communication while driving. Council President Saponaro asked, any questions? There were none.
