Minutes of the Regular Meeting of Council <br />Monday, February 25, 2019 <br />Page 14 <br />First Read'nng of Oa-dinance No. 2019-09, entitled, "An Ordinance repealing and <br />replacing Codified Ordinance Chapter 1185 relating to signs regulations." Introduced by <br />Mayor Bodnar. (Law Department) <br />Mr. Coyne stated, if you have any questions on this, I will certainly answer them. There is one <br />section I would like to have considered to be an amendment to it. 1185.08, Signs Permitted in <br />Anv District, specifically Section (f), if you look at (f)(4), it says "Such signs shall be located as <br />close to the center of the property as possible as measured by the front footage, but in no event <br />less than 10 feet from the property line." Section (fl(1) says "Such signs shall be located not less <br />than 20 feet from the right-of-way line." In speaking with Mr. Marrelli and also at the <br />Department Heads meeting, we had a discussion about how you would be able to measure that, <br />particularly on streets where there might not be a sidewalk and there might not be a clear <br />delineation of where the right of way line is. To enforce it, it was suggested that we modify <br />Section (f)(1) to state it would be 10 feet from the edge of the roadway surface. So it would have <br />to be on private property, 10 feet back from the edge of the roadway surface. <br />Council President Saponaro asked, tell me this section again? <br />Mr. Coyne replied, it would be amending Section 1185.08(f)(1). It says 20 feet from the right- <br />of-way line. I will have this corrected for the next meeting. The end of that should be 10 feet <br />from the edge of the roadway surface. <br />Council President Saponaro asked, all right, so such signs shall be located not less than 10 feet <br />from the edge of the roadway surface? <br />Mr. Coyne replied, yes. That's the suggested amendment and it is in consultation with the <br />Building Department and also at the Department Head's meeting we discussed it thoroughly. <br />Council President Saponaro asked, so that change is going to be done and you will provide us <br />with an update? <br />Mr. Coyne replied, yes. <br />Council President Saponaro asked, anything else you want to talk about on this? <br />Mr. Coyne replied, I don't think so. If anyone has any questions, I would be glad to answer <br />them. <br />Council President Saponaro stated, it's a pretty lengthy ordinance. Hopefully everyone has gone <br />through it and if you haven't, do that so that at our next meeting we can continue the discussion <br />on this with any questions or things of that nature regarding this ordinance because it's pretty big <br />and it does dive deep into an area that has had a lot of case law come out on it so I just wanted to I <br />make sure everyone understands it before we put it to a vote. <br />Ordinance No. 2019-09 moved to Second Read.
