Collective Bargaining Agreement between <br />Mayfield Village and the I.A. F. F. Local 2619 <br />shall continue from year to year beyond the original term hereof unless either party notifies the <br />IL other in writing of its intent to amend, modify, or terminate the Agreement by certified U.S. mail <br />not later than ninety (90) days nor earlier than one hundred twenty (120) days prior to the <br />expiration date of the Agreement. <br />[A <br />Section 39.2. If either party desires to modify, amend or terminate this Agreement, it shall give <br />written notice of such intent no earlier than one hundred twenty (120) calendar days prior to and no <br />later than ninety (90) calendar days prior to the expiration date of this Agreement. Such notice shall <br />be by certified mail with return receipt. Negotiations will commence as soon as practical thereafter. <br />ARTICLE 40 <br />PREVAILING RIGHTS <br />Section 40.1 All rights, privileges and working conditions enjoyed by the employees at the <br />present time which are not included in this Agreement shall remain unchanged unless by mutual <br />consent of both the Village and the union. <br />ARTICLE 41 <br />NEGOTIATION PROCEDURE <br />Section 41.1. The parties shall meet at a place and time mutually convenient as soon as practically <br />possible after receipt of such notice in order to begin negotiations in good faith for a successor <br />agreement, pursuant to the following guidelines: <br />A. Location of meetings <br />Meetings will be held on the premises of the Employer. <br />B. Dates and times of meetings <br />Sessions will be scheduled by mutual agreement on an as needed basis and will last for <br />no more than three (3) hours in duration. If further meeting time is required following <br />adjournment, nothing herein shall limit the parties from mutually consenting to <br />schedule a limited agenda meeting immediately following the regularly scheduled <br />meeting. <br />C. Bargaining committee make-up <br />The union team will consist of no more than three (3) participants. Union team <br />members shall not suffer the loss of their straight time regular rate of pay for attendance <br />with the employer's team in any negotiation session. <br />Either party may have up to one (1) additional individual appear at a session for the <br />purpose of providing information that may aid the parties in their negotiations. Said <br />additional person will be permitted to attend on a limited basis. <br />30 <br />
