Minutes of the Regular Meeting of Council
Tuesday, January 21, 2020
Page 12
Council President Schutt asked, discussion?
There was none.
ROLL CALL: AYES: All Motion Carried
NAYS: None Ordinance Enacted
Appeal of Russell Previte of the Board of Appeals' decision dated December 17,
2019 denying his application for a sideyard setback variance.
Council President Schutt stated, Mr. Previte, did you want to speak about this? If so, please
come up to the podium and state your name and address for the record.
Russ Previte
6757 Thornapple Drive
Good Evening. My name is Russ Previte. My wife and I reside at 6757 Thornapple Drive. Based
on recommendations, it says recommendations but Ms. Jeanblanc decided that, I had called her
four or five times and left a message. I met her in a parking lot here and she said she would
rather not have her name mentioned. Based on recommendations by and I am going to read that
because she did acknowledge that she did say this portion, so, Based on recommendations by
John Marrelli and Alexandra Jeanblanc this appeal to Council is being made. My hope is Council
will reconsider the December 17'h 2019 decision made by the Board of Zoning Appeals and
approve our fence enclosure. This presentation to Council is a short summary of circumstances;
hoping to clarify a conflict of understanding and clear the way for approval of our fence
enclosure on Thornapple Drive.
This summary begins and ends with an enclosed fence permit which was issued to me on
October 24, 2017. I will try my best to stay with the most relevant issues and maintain a coherent
timeline.
The permit was issued for a fenced enclosure — not a shed. Two posts had been installed along
the west side property line before the permit was issued. I was notified I needed a permit and
went to visit with Mr. Marrelli. After some conversation I was provided a plot plan map by Mr.
Marrelli and his secretary and marked the location and dimensions on this plot plan (copy
attached). I also provided a sketch of the fence enclosure showing necessary dimensions along
with several notes on the sketch; one of these notes clearly states "optional enclosed for weather
and appearance" (copy attached). We also discussed several ways of keeping the garbage,
rubbish, and grass clipping cans from being seen from the street. These included adding a gate,
or a small section of fence running perpendicular from west to east off the south end of the
structure.
