The Board of Appeals looked at the plot plan and they said it's 9 <br />inches off the property line. It's in the sideyard and there is no particular hardship that Mr. <br />Previte could demonstrate. Chairman Syracuse said considering whether there is a practical <br />difficulty, we have to look at conditions on which the application was based, particularly to the <br />subject property, with respect to the physical size, shape or characteristics. He went on to <br />explain that the variance would result in an improvement of the property that is more appropriate <br />and more beneficial. On motion it was denied because there was nothing particular to this <br />property that would allow the shed to be in the sideyard. That's the long and short of the Board <br />of Appeals. On the other hand, there was another appeal for a fence on the east end of the <br />property which was granted which we are still waiting to get the permit for. That's another <br />thing. <br />Mr. Previte stated, which we are not talking about by the way at this meeting.
