Minutes of the Regular Meeting of Council <br />Tuesday, January 21, 2020 <br />Page 16 <br />done, it will require 2/3rds vote of Council. The absence of Mrs. Mills it will require 4 of you to <br />overturn the Board of Zoning Appeals. We have not to my knowledge had one of these appeals <br />in a very very long time. <br />Mr. Previte asked, just for the record? <br />Mr. Coyne replied, sure. <br />Mr. Previte stated, so the addition did become all of a sudden a setback. You understand that, <br />correct? <br />Mr. Coyne replied, right. Yes. <br />Mr. Previte stated, so that was never an issue. <br />Mr. Coyne stated, Mr. Marrelli can maybe explain that, how that arose before the Board of <br />Zoning Appeals and then you can certainly respond back if Council has any questions. <br />Mr. Previte stated, it was suggested by John, I think it was John, to take the roof off and take the <br />doors off possibly. <br />Mr. Marrelli stated, to make it a fence again. <br />Mr. Previte stated, and make it an enclosed fence, but not really anymore because it's not <br />enclosed. <br />Mr. Marrelli stated, it's enclosed on three sides. <br />Mr. Previte stated, I have my somebody babysitting for my wife. She's right now at a late stage. <br />I'm not going to get into an argument like I said. I will answer some questions, but I am not <br />going to go tit for tat like these two did earlier because it's not worth it. <br />Mr. Coyne stated, you don't have to respond anymore if you don't want to, but we want to hear <br />from Mr. Marrelli because he's the Building Commissioner. He attended the meeting. He also <br />issued the original permit for the fence. Let's let Mr. Marrelli address Council and then I would <br />ask that you just address the Council President. <br />Mr. Marrelli asked, would you like me to just go over the Board of Appeals and not recap <br />everything? <br />Mr. Coyne replied, that would be fine. <br />Mr. Marrelli stated, the Board found that the enclosure was actually a shed because of the roof <br />and the front on it. It's fully enclosed on four sides and has a roof. So, it was classified as a <br />shed. Sheds are not permitted in the sideyard whereas fences are. It was recommended that <br />either Mr. Previte, and it was from me, either change it back to a fence which is take the roof off <br />
