Minutes of the Regular Meeting of Council <br />Tuesday, January 21, 2020 <br />Page 20 <br />Mr. Murphy asked, so at what point should Mr. Previte have come back to the Board of Zoning <br />Appeals? <br />Mr. Marrelli replied, I don't think he can come back. <br />Mr. Murphy asked, during this process, when he changed his mind, the weather cleared and he <br />said, all right, I'm going to put a roof on this. At that point does he have to come back and get <br />that approved? <br />Mr. Marrelli replied. Here's what happens. When somebody exercises an option or alters their <br />drawing, they are supposed to bring that alteration in for approval as well. Had that happened, <br />and I saw a roof and a full enclosure, I would have informed him he can't do that. He turned it <br />into a building. It's no longer a fence. That didn't happen. He just decided that his note that <br />says I'm going to weatherize it meant that he could change the whole structure. <br />Mr. Previte stated, I am going you guys because I don't like that tone at all. I can see this thing <br />is not going to flow with this guy and he's the boss here. So long. I hope the Council votes with <br />their conscious because there's a hell of a lot of work done in that thing. <br />Mr. Previte left the meeting. <br />Mr. Coyne stated, Council President, you can table the matter and discuss it and reconvene at <br />another meeting if you want to. <br />Mr. Marrelli asked, did I answer your question? <br />Mr. Murphy replied, yes. It's optional enclosed on here that's kind of like a gray area. It's not <br />black and white. <br />Mr. Marrelli stated, a substantial change in construction requires a resubmission. That's like a <br />guy saying I'm going to build a garage, I want a two -car garage with an option for storage and I <br />go out there and it's two stories high and he says, I said I was going to put extra storage in there, <br />but he didn't say it was going to go two stories, he just said he was going to put storage. We <br />can't guess what they're doing. We have to rely on drawings and that's why I relied on the <br />drawing and that's why I issued the permit for what was drawn not what he imagined it could be <br />in the future. <br />Ms. Jurcisek asked, had there been any complaints by the neighbor regarding this? <br />Mr. Marrelli replied, the neighbor to the west was concerned when the post went in the ground <br />that the fence was off of the property line. We questioned Mr. Previte and he said, no, I know <br />where my property line is and it's on my property. <br />Ms. Jurcisek asked, have you heard from any neighbors since it's been built? <br />Mr. Marrelli replied, no. <br />
