Minutes of the Regular Meeting of Council
Tuesday, January 21, 2020
Page 25
Mr. Coyne stated, and you would have to have a second to do that.
Council President Schutt stated, so then we would kind of be talking for Mr. Previte then on
something that he might not want to do anyway.
Mr. Coyne stated, that's correct. He was asked if he wanted to do that at the Board of Zoning
Appeals, I believe.
Council President Schutt stated, and he can always go back and take the roof and doors off and
be compliant and pay his fee as well.
Mr. Coyne stated, and be compliant.
Council President Schutt stated, well at this point I don't think we really should even make a
motion to change that then because we are speaking for him when he is not even present.
Rick Christian
I have a question. Why would you have to take the roof and the doors off?
Mr. Marrelli replied, because it's a fence permit, not a building permit.
It's a fence. You can have four sides on it.
Mr. Marrelli asked, and a roof?
No. I said, why would you have to take the roof and the doors off?
Mr. Marrelli replied, he might not. He could just take the roof off.
If he took the doors off and left the roof on, it's still an open structure.
Mr. Marrelli replied, it's a shed. When you put four sides and a roof on, it's enclosed.
What if he put 3 sides of the roof on?
Mr. Marrelli replied, it's a structure. The only structures that are allowed in the sideyard is a
fence. When you put a roof on a fence, it's not a fence anymore, it's a gazebo or it's whatever,
but it's not a fence anymore.
Council President Schutt stated, thanks for your comment. We are going to keep on moving
forward. The Open Portion of the meeting is over. At this point in time, we agreed with the
Board of Appeals.
