We voted against them. We
can vote to modify what they said.
Mr. Coyne stated, it was 3-3. In order to overturn the BZA, it would have required a fourth vote.
You didn't get it. So, it fails.
Mr. Marquardt stated, so you can vote to modify it now.
Mr. Williams stated, you have to make a motion.
Mr. Coyne stated, you would have to make a motion and your seconder would have to agree to
the modification of your motion.
Mr. Marquardt asked, of the first motion?
Mr. Coyne replied, yes. If you want to do that. It would be unusual, but sure. You can do it at
the next meeting too.
Mr. Jurcisek stated, since it's denied, he can still go back to the original permit to take off the
roof and doors?
Mr. Coyne stated, correct. He could go back and do that. Absolutely. That's still open but he's
going to have to make application too. He hasn't paid for his permit to do that in the first place.
Mr. Marrelli stated, if he changes that structure into what was on the plan then he is going to be
legal. That's what we asked.
Mrs. Jurcisek stated, correct. Thanks.
Council President Schutt asked, if we take a motion and modify then, it would have to be
specified what it is modified to, is that correct?
