Minutes of the Regular Meeting of Council <br />Tuesday, January 21, 2020 <br />Page 24 <br />Council President Schutt asked, any other questions or discussion? <br />There was none. <br />ROLL CALL: AYES: Jurcisek, Marquardt, Murphy Motion Failed <br />NAYS: Meyers, Williams, Schutt 3-3 <br />Council President Schutt stated, the Motion failed 3-3. <br />Mr. Coyne stated, correct. <br />Mr. Marquardt stated, vote to modify it. <br />Mr. Coyne stated, you just voted. <br />Mr. Marquardt stated, no, we didn't vote for the Board of Appeals. We voted against them. We <br />can vote to modify what they said. <br />Mr. Coyne stated, it was 3-3. In order to overturn the BZA, it would have required a fourth vote. <br />You didn't get it. So, it fails. <br />Mr. Marquardt stated, so you can vote to modify it now. <br />Mr. Williams stated, you have to make a motion. <br />Mr. Coyne stated, you would have to make a motion and your seconder would have to agree to <br />the modification of your motion. <br />Mr. Marquardt asked, of the first motion? <br />Mr. Coyne replied, yes. If you want to do that. It would be unusual, but sure. You can do it at <br />the next meeting too. <br />Mr. Jurcisek stated, since it's denied, he can still go back to the original permit to take off the <br />roof and doors? <br />Mr. Coyne stated, correct. He could go back and do that. Absolutely. That's still open but he's <br />going to have to make application too. He hasn't paid for his permit to do that in the first place. <br />Mr. Marrelli stated, if he changes that structure into what was on the plan then he is going to be <br />legal. That's what we asked. <br />Mrs. Jurcisek stated, correct. Thanks. <br />Council President Schutt asked, if we take a motion and modify then, it would have to be <br />specified what it is modified to, is that correct? <br />
