Minutes of the Regular Meeting of Council
Tuesday, January 21, 2020
Page 23
Mr. Marquardt replied, that's correct.
Mr. Coyne stated, okay, just for the record, that's what the motion would be.
Mr. Meyers asked, in that motion, would that be modified, or would that be the way it sits now
with the roof?
Mr. Marquardt replied, the way it sits now.
Mr. Meyers asked, would that set precedence over somebody else?
Mr. Marquardt stated, nobody cares about it right now.
Mr. Murphy stated, so basically, you're just kicking the can down the road.
Mr. Marquardt stated, right.
Mr. Meyers stated, it would be a case by case basically.
Mr. Williams stated, point of order. There's a motion on the floor.
Mr. Marquardt stated, no modifications. Just the way it is.
Mr. Murphy asked, and that vote would need?
Mr. Coyne replied, 4 out of 6.
Mr. Williams stated, it needs a second first.
Motion to overturn the decision of the Board of Zoning Appeals.
Mr. Marquardt, seconded by Mr. Murphy, made a motion to overturn the decision of the Board
of Zoning Appeals.
Council President Schutt asked, discussion?
Mr. Murphy asked, Mr. Coyne, voting yes -
Mr. Coyne replied, absolutely. A yes vote would mean that the Board of Zoning Appeals'
decision to deny his permit application would be overturned. A no vote would mean it would not
be overturned and the decision of the Board of Zoning Appeals would stand. So, if you want to
vote in favor of the Board of Zoning Appeals, you would vote no on Councilman Marquardt's
motion. If you want to overturn the Board of Zoning Appeals, you would vote yes. And it will
require 4 votes.
