Minutes of the Regular Meeting of Council <br />Tuesday, January 21, 2020 <br />Page 22 <br />Council President Schutt asked, any other comments? <br />There were none. <br />Council President Schutt asked, Tony, then we will move to vote on this now? <br />Mr. Coyne stated, you can make a motion to affirm the BZA or to overturn or modify it. One of <br />those three. To modify or overturn the BZA would require 2/3rds of Council. <br />Mr. Meyers asked, to modify. Would that be to modify the building or modify the decision? <br />Mr. Coyne replied, you can do either one actually. I think that if you look at the actual plan, it <br />looked like he was putting up a fence when it does look like he was going to have two sides <br />coming out because he was going to put garbage cans there. You could say that he has to take the <br />roof off and the doors off. It's up to you. <br />Mr. Meyers stated, like I just asked, if he could remove the roof and still have the structure. <br />Mr. Coyne stated, he should, as Mr. Marrelli indicated, come back to the Building Department <br />with the revised plans so that it is going to look appropriate. He didn't want to talk about it, but <br />he did put up the fence first. He has not come in to pay for his building permit. The Board of <br />Zoning Appeals did approve the fence as I understand it. <br />Mr. Marrelli replied, yes, that's correct. <br />Mr. Meyers stated, I did have a question that night for Katie after the meeting about how do you <br />apply for a variance or come to the Board of Appeals if you never got a permit. <br />Mr. Coyne stated, that's a good question. <br />Mr. Meyers stated, I never got an answer. <br />Mr. Coyne stated, okay, it's a good one and it's actually asking for forgiveness and in your Code <br />you can do that and you are supposed to pay twice what the Building Permit normally costs and <br />you should be given consideration if it meets the Code. As I understand it, it did. The Board of <br />Zoning Appeals was accommodating to him even though he still has not come in to take out his <br />permit. <br />Council President Schutt stated, okay, we will bring this to a vote then for Council. <br />Mr. Marquardt asked, what are we going to vote on? I make a motion to vote against the Board <br />of Zoning Appeals of the building. That's what I am proposing. <br />Mr. Coyne stated, so your motion would be to overturn the decision of the Board of Zoning <br />Appeals? <br />
