ORDINANCE NO. 2022-18 <br />Page 24 <br />1128.18 APPEALS <br />Any person aggrieved by any order, requirement, determination, or any other action or inaction <br />by the Village in relation to this regulation may appeal to the court of common pleas. Such an <br />appeal shall be made in conformity with Ohio Revised Code Chapter 2506. Written notice of <br />appeal shall be served on the Village. <br />1128.99 PENALTY <br />A. Any person, firm, entity, or corporation; including but not limited to, the owner <br />of the property, his agents and assigns, occupant, property manager, and any <br />contractor or subcontractor who violates or fails to comply with any provision of <br />this regulation is guilty of a misdemeanor of the third degree and shall be fined <br />no more than five hundred dollars ($500.00) or imprisoned for no more than sixty <br />(60) days, or both, for each offense. A separate offense shall be deemed <br />committed each day during or on which a violation or noncompliance occurs or <br />continues. <br />B. The imposition of any other penalties provided herein shall not preclude the <br />Village from instituting an appropriate action or proceeding in a Court of proper <br />jurisdiction to prevent an unlawful development, or to restrain, correct, or abate a <br />violation, or to require compliance with the provisions of this regulation or other <br />applicable laws, ordinances, rules, or regulations, or the orders of the Village." <br />SECTION 2. Any sections of the Codified Ordinances in conflict herewith are hereby and <br />herein repealed and amended accordingly. All other provisions of the Village Codified Ordinances <br />not inconsistent herewith shall remain in full force and effect. <br />SECTION 3. The Clerk of Council is authorized and directed to forward a certified copy <br />of this Ordinance to the Codifier of Mayfield Village. <br />SECTION 4. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council and <br />that deliberations of this Council and of its committees, resulting in such formal action, took place <br />in meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />11 <br />
