N/ ORDINANCE NO.2023-20 INTRODUCED BY: Mayor Bodnar AN ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE REPAIR OF SIDEWALKS IN THE AINTREE PARK, AINTREE NORTH AND SANDALWOOD NEIGHBORHOODS, AND DECLARING AN EMERGENCY WHEREAS, Council, pursuant to Resolution 2023-42 (as amended), passed August 21, 2023, determined it necessary to repair certain identified sidewalks within the Village in the Aintree Park, Aintree North and Sandalwood neighborhoods; and WHEREAS, each adjacent property owner was notified by letter on or about May 25, 2023, and then again on or about September 1, 2023, indicating the need for the necessary sidewalk repairs and providing the opportunity to repair the identified sidewalks or pay the Village to make said repairs; and WHEREAS, many property owners either repaired their sidewalks or made payment to the Village, for the Village to make said repairs; and WHEREAS, the remaining sidewalks have now been repaired; and WHEREAS, Council now deems it necessary for the public health, safety and welfare of the Village and its residents, that the Village's costs of repairing the identified sidewalks be assessed against each of the adjacent property owners, as per the actual costs of said construction i.e., at a cost of $350.00 per sidewalk block repaired. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The estimated assessments of the costs for the repair of such sidewalks, within the Village, in the Aintree Park, Aintree North and Sandalwood neighborhoods, reported to the Council and now on file in the Office of the Clerk of Council, and totaling in the aggregate Twelve Thousand Six Hundred Dollars ($12,600.00), are adopted and confirmed. SECTION 2. Those portions of the total cost of the repairs to be paid for by special assessment, as is set forth in Exhibit "A", a copy of which is attached hereto and incorporated herein, are hereby levied and assessed upon the lot and lands abutting the certain sidewalks. SECTION 3. It is determined that the special assessments do not exceed the special benefits resulting from the improvement, and do not exceed any statutory limitation. SECTION 4. The Clerk of Council is determined to continue to have on file in her office a list of these assessments and the description of the lots and lands being assessed.
