Belzer <br />A RESO'LUTION NIDSORIAZIZIIIG '.C''tiE 104TH GENFRAL ASSEPd3LY <br />OF THE LEGISI,ATURE, OF THE STATE OF OHIO, TO AIIEND <br />SECTION 731,09 OF THE REVISED CODE OF_THE STATE OF OHIO, <br />RELATIVE TO THE EI,ECTTON OF MENIBERS TO VIL-LkGE LEGTSLATIVE <br />AUTHORITIES,, AND DECLARING AN EMERGENCY. <br />WHEREAS, Section 731409 of the Revised Code of the State of Ohio provides <br />that the members of the legislative authoritp of a village shall be elected at <br />large f or terms of f our years; and <br />CqIIEREAS, it provides fnrther that in th.e year 1961, two members shall <br />be elected for terns of two years and four members shall be elected for terms <br />of f our years ; and <br />WHEREAS, it f urther provides that candidates ior such legislative <br />authority sha11 declare whether they shall run f or a four-year or a tcao-year <br />term; and <br />WHEREAS, it is the opinion of this Council that such requirements are <br />unf avorable to candidates wishing to run ior the position of Village Councilman <br />as it reduces the opportunity of a candidate to compete f or one of six seats <br />to one of our or to one of two seats depending upon the tenu f or which such <br />candidate shall elec-t to run; and <br />GIHERE-AS, under said section it is possible for a candidate to receive <br />? the f if th highest number of popular votes and be def eated cahile another <br />candidate running for a tcvo-year term could Ue elected with a fewer number <br />of the popular vote; and <br />WHEREAS,, under the proposed amendment the term of the candidate is <br />determined by the number of popular votes he may receive and the ballot <br />presented to the elactors would be simpler, less confusing and more economical <br />to print and to count; and <br />WHEREAS, many charter municipalities have chosen the f orm of electing <br />legislative representative as is herein proposed in the f ollowing amendment; <br />NOW THFREFORE BE IT RESOZVED BY THE COUNCIZ OF THE VIZZAGE OF i-AIAYrIELD <br />CUYAAOGA COUNTY, OHIO, FTCE MMiBERS ELECTED TIIERETO CONCURRTNG: <br />Sec. 1. That this Council respectfully requests the members of the <br />104th General Assembly of the Zegislature of the State o£ Ohio to amend Section <br />731.09 of the Revised Code of the State ot Ohio f or the reasons hereinbef ore set <br />forth and that such amendment shall be as introduced by Senator Joseph G7, Bartunek <br />in Senate Bill No. 186 and which reads as f ollowsa
