ORDINANCE N0. 84-36 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE SUBMITTING TO THE <br />ELECTORATE OF MAYFIELD VILLAGE, <br />OHIO, A PROPOSED AMENDMENT TO <br />ARTICLE IX, SECTION 2 OF THE <br />CHARTER OF SAID MUNICIPALITY <br />AUTHORIZ ING THE LEVY OF TAXES FOR <br />THE PURPOSE OF CONDUCTING GENERAL <br />MUNICIPAL OPERATIONS_AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, Article X of the Charter of Mayfield Village, Ohio, <br />entitled "Amendments to Charter" provides that the Council may, by the <br />affirmative vote of at least two-thirds (2/3) of its members, submit <br />to the electorate of the municipality proposed amendments to the <br />Charter; and <br />WHEREAS, Article XVIII, Sections 8 and 9 of the Ohio <br />Constitution provide that such proposed amendment be submitted to the <br />electorate not less than sixty (60) nor more than one hundred twenty <br />(120) days after the passage of such ordinance proposing a Charter <br />Amendment; and <br />WHEREAS, Article IX, Section 2 of the Charter of Mayfield <br />Village, Ohio, currently provides that the power of Council to levy <br />taxes is subject to the limitations set forth in the Constitution and <br />the general laws of the State of Ohio; and <br />WHEREAS, the Council of Mayfield Village has determined to <br />authorize and direct the submission to the electorate of the munici- <br />pality the proposed Charter Amendment hereinafter set forth at the <br />general election to be held on November 6, 1984; now, theref ore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. There is hereby proposed to the electorate of <br />Mayfield Village, Ohio, an amendment to Article IX, Section 2 of the <br />Charter of Mayfield Village, Ohio, which shall be substituted for the <br />currently existing Article IX, Section 2 as follows: <br />Section 2. Limitations on Rate of Taxation. <br />Commencing with the tax list and duplicate for <br />the year 1984, and continuing each year thereafter, <br />the Council of Mayfield Village may levy in each <br />year, without a vote of the people, a tax in an <br />amount not to exceed in each such year three (3) <br />mills per dollar of assessed valuation upon all <br />property in the municipality assessed and listed <br />
