RESOLUTION N0. 82- $j <br />INTRODUCED BY: Kayor & Counci:l as a Wh.ole <br />A RESOLUTION AUTHORIZING THE PAYMENT OF <br />TWO HUNDRED FIFTY THREE DOLLARS TWENTY <br />THREE CENTS ($253.23) TO JOSEPH A. PALERMO <br />AND VIOLET L. PALERMO AS REIMBURSEMENT FOR <br />PROPERTY TAX OVERPAYMENTS AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the Municipality acquired, as the result of certain <br />litigation, the premises located at 596 S.O.M. Ceriter Road, the <br />same being Permanerit Parcel No. 83I-11-17; and; <br />WHEREAS, in 1979 the Village agreed to sell approximately <br />one-half (1/2) of the subject premises to Joseph A. Palermo and <br />Violet L. Palermo; and <br />WHEREAS, it was the intent of both the municipality and the <br />Palermos that only the front three hundred fifty (350) feet of the <br />premises was to be transfered to the Palermos; and <br />WHEREAS, an error was made in the legal description of the <br />property included in the preparation of the warranty deed transferring <br />title of the premises from the municipality to the Palermos, such <br />error resulting in the transfer of the entire parcel to the Palermos, <br />the depth of the entire parcel being 707.15 feet; and <br />WHEREAS, as a result of the said error, the Palermos have <br />been paying, since 1979, real property taxes on the entire parcel, <br />which includes a residential premises on the front portion and <br />unimproved land on the rear portion9 the'latter be'ing that portion <br />of the parcel that was to be retained by the municipality; and <br />WHEREAS, the said error was receritly discovered and, with the <br />cooperation of the Palermos and Continerital Tit1e A.gency Corporation <br />it has been determined that the Palermos have overpaid the sum of <br />Two Hundred Fifty Three Dollars Twerity Three Cents ($253.23) in <br />property taxes, the same represeriting the taxes due on the rear portion <br />of the premises that should have been attributed to the municipality; <br />and <br />WHEREAS, the Palermos have already executed a quit-claim deed <br />to the municipality transfering al1 of their right, title and interest <br />in and to the said rear portion of the premises to the municipality; <br />and <br />WHEREAS, it is in the best interest of fairness and justice <br />to reimburse the Palermos foz the payment of property taxes made <br />through no error of their own; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VTLLAGE, OHTO, THAT:
