ORDINANCE N0. 396 <br />By Mr. Walz <br />PROVIDING FOR THE EBQPLOYIIHENT OF AN ENGINEER <br />FOR THE VILLAGE. OF HAYFIELD, OHIO. <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, STATE OF OHIO: <br />Sec. 1. That H. C. Gallimore, be, and he is hereby employed and <br />appointed as Engineer within and for the Village of hayfield until December <br />31, 1963. <br />Seo. 2. That as Engineer he shall furnish the following services to <br />the municipality: <br />(a) He shall prepare all necessary plans, profiles, specifications <br />and estimates of cast of every kind for all public improvements. <br />(b) He shall supervise and serve as the representative of the <br />Municipality in the execution of all public work undertaken by this <br />Council, pursuant to plans and specifications approved by this Council. <br />(c) He shall supervise and direct all Inspectors, appointed by the <br />Road Committee of this Council and such Inspectors shall report to and <br />receive their instructions from him. <br />( d) He will furnish to the Council plans, specifications and estimates <br />of cost of all improvements for the guidance of this Council and for the <br />information and guidance of contractors dealing with the municipality. <br />(®) Upon request, he shall make and deliver to this Council monthly <br />reports of the progress of improvements under his oharge, stating conditions <br />of same together with any other matters of interest desired by this Council. <br />All plans shall be the property of the municipality and, when so directed <br />by the Council, be filed in the Clerk's office, upon completion of any <br />improvement. <br />(f) His services shall be available to any Department of this <br />B~unicipality and to any Official acting in his official capacity, in <br />connection with the municipal business. <br />(g) He agrees that throughout the life of this contract he shall <br />have in his employ a competent R®gistered Professional Engineer whom he <br />shall desigbate as his Principal Assistant and until further notice h® <br />hereby designates Frank L. Woodruff as his Principal Assistant. Said <br />Principal Assistant shall, during any absence or disability of said H.C. <br />Gallimore, have all the prnrrers and dutios which the law or this contract <br />imposes on said H. C. Gallimore. <br />Sec. 3. That the Municipality shall pay H. C. Gallimore for services <br />rendered by him as f oll ours : <br />(a) If the proceedings for any improvement are completed according <br />to the usual schedule as provided by law so that bids are received and contract <br />awarded, he shall be paid a sum equal to three percent (3/) of the bid submitted <br />by th® successful contractor as soon_as funds for said improvement are in the <br />Treasury. As the work is constructed he shall receive additional oompensation <br />equal to thr®e percent (3/) of the actual cost of work completed, said sum to b® <br />
