TIDE END OF THE DIDICATID STREET, WHICH TS 1315.60 FEE`I'_ FROM THE SOUTH LINE OF VffIL50N MTLLS.ROAD BY THE CONSTRUCTION OF A ti'VATF~R MAII~T AND APPURTENANCES THEREIN. WHEREAS, there has been regularly presented to the Council of the Vi11.a:ge of Nfayfield, Cuyahoga County, State of Ohio, a Petition in writing, 4.--_ subscribed by three-fourths in interest of the owners and the owners of more than 60~ of the foot frontage-of the property abutting upon Worton Park Drive, from VYilson Mil.l.s Road to the end of the dedicated street, which is 1315.60 feet from the South side of Wilson Dills Road, praying that the entire cost of construction of an 8~~ water main and appurtenances in said Worton Park Drive between said points, including the cost of improving street inter- sections and such part of the cost of said improvement as is ordinarily paid or required to be paid by the Villages under the provisions of Section 3820 of the General Code of Ohio, or under aa~y other statutes authorizing or requiring a municipal corporation to pay a part of such cost, shall be assessed in proportion to the benefits that might result from such improve- ment to the lots and-lands fronting on sari street between said points, without reference to the~:~value.of the lands of those who subscribed to said Petition, and ~ ~ ~ - -~ -. ~:'1HEREAS, this Council adopted. Resolution No. 219 on June 7-5, 7.953, declaring the .necessity of improving Worton Park Drive~in the Village of Mayfield, Ohio; from Wilson 1~ii.].ls Road to the end _of the dedicated street, which is 1315.60 feet from the South line of li~ilson It~i.11s Road by the construction of a water main and appurtenances~~in~accordance with the plans, specifications, estimates and profiles,~prepared by-the Village Engineer and nova on file in the office of the Clerk of the Village of Mayfield, and 'VJ!-IEREAS, a. Certificate of the Clerk has been filed with the Council showing. service of notice of the passage of such Resolution No...- 219 on the owner of -each piece of property abutting on_Worton Park Drive ,from tiVilson 14ti.lls Road to the end of the dedicated street; which is 1315.60 feet from the South line of Wilson Mills Road, and WHEREAS, the Clerk has certified that no claims for damages have been filed during the claim period, and S, the Council of the ViLl.age of Mayfield desires to proceed with said improvement.
