ROAD TN THE VILLAGE OF, T4TAYFZELD, OHIO FROM.SOM CENTER ROAD IN .AN EASTERLY DIRECTION TO THE WEST~RT,Y LINE OF BEACH HJZL ROAD BY THE. CONSTRUCTION. OF A WATER MAIN AND APPURTENANCES THEREIN. 'U'lHEREAS, there has been regularly presented to the Council of the Village of Mayfield, Cuyahoga County, State of Ohio, a Petition in writing, subscribed by three fourths in interest of the owners and the owners of more than 60~ of the foot frontage of the property abutting uponBonnievie~ Road, from SOS Center Road in an Easterly direction to the Westerly line of Beach Hill Road ,praying that the entire cost of construction of an 8« water main and appurtenances in said Bonnieview Road between said points, including the cost of improving street intersections and such part of the Bost of said improvement as is ordinarily paid or required to be paid by the Villages under the provisions of Section 727.16 of the Revised Code of Ohio, or under any other statutes authorizing or requiring a municipal corporation to pay a part of such cost, sha11 be assessed in proportion to the benefits that might result from such improvement to the lots and lands fronting on said street between said points, without reference to the value-of the lands of those who subscribed to said Petition,. and VV~IEREAS, this Council adopted Resolution No. 223 on July 21, 1953, declaring the- necessity of improving Bonni.eva.ew Road in the .Vil.].age of Mayfield, Ohio, from SOM Center Road ri an Easterly direction to the Westerly line of Be~;eh Hill Road by the construction of a water ma3.n and appurtenances' in accordance with the plans, specifications' estimates and profiles prepared by the Village Engineer and now on file in the office of the Clerk of the Village of lGtayfield, and WHEREAS, a Certificate of the Clerk has been filed with the Council. sho~ri.ng service of notice of the passage of such Resolution No. 223 on the owr9er of each piece of property abutting on Bonni.eview Road from SOM Center Road in an Easterly direction to the Westerly line of Beach Hill Road, and tiUHEREAS, the Clerk has certified that no claims for damages have been filed during the claim period, and WHEREAS, the Council of the Village of Mayfield desires to proceed with said improvement.
