LEECH <br />A RESOLUTION AUTHORIZING THE SOLICITOR OF THE VILLAGE <br />OF HAYFIELD TO APPROVE A JOURNAL ENTRY TO ENABLE THE <br />"INTERIM'` DISTRIBUTION OF LOCAL GOVERNMENT FUNDS. <br />tr~,l <br />,,; <br />~E~~pf <br />i!--t1 <br />I <br />~:, <br />;R <br />:t~ <br />;_ ~ 1 <br />~~.. <br />~, <br />-a: <br />_.~ <br />r.' <br />s, <br />,~~, <br />jiJGr <br />GTHEREAS, certain litigation pending in the Franklin County Court of <br />Appeals has the effect of preventing distribution of the 1971 local govern~ent <br />funds; and <br />G?HEREAS, it is necessary that we have so much of these funds as is <br />possible in order to meet the financial needs of our municipality; and <br />WHEREAS, the Franklin County Court of Appeals has indicated that if <br />all or substantially all governmental units agree to a Journal Entry, a dis- <br />tribution of approximately Dlinety percent (90%) of an amount equal to the "low" <br />award by either the County Budget Commission or the Board of Tax Appeals will <br />be permitted; and <br />WHEREAS, the proposed Journal Entry has provisions for repayment in <br />the event the advance to any subdivision is greater than the final determina- <br />tion of the Court. <br />NOW, THEREFORE, Be It Resolved By The Council of The Village of <br />rlayfield,County of Cuyahoga, State of Ohio: <br />Section 1. That the Solicitor be and he is hereby authorized to <br />approve and to execute in behalf of the Village of Mayfield a Journal Entry <br />authorizing an interim distribution of local government funds in the manner <br />and form as follows: <br />"IN THE FRANKLIN COUNTY COUP.T OF APPEALS" <br />CITY OF EAST CLEVELAND <br />and <br />CITY OF CLEVELAND, ET AL., <br />CASE N0. 71-314 <br />Appellees <br />-vs- <br />OOUNTY OF CUYAHOGA <br />Board of County Commissioners, <br />JOURNAL ENTRY <br />Appellant <br />Jl <br />n, <br />This matter came on to be heard this day of , <br />, on the motion of the consenting subdivisions of Cuyahoga County, Ohio, <br />
