ORDINANCE N0. 86-18 (AS AMENDED) <br />INTRODUCED BY: Council President, Richard C. Etzler <br />AN ORDINANCE PROVIDING A PROCEDURE TO RETAIN THE <br />SERVICES OF A PROFESSIONAL PLANNING EXPERT TO <br />STUDY THE ZONING IN CERTAIN AREAS OF THE <br />MUNICIPALITY AND DECLARING AN EMERGENCY. <br />WHEREAS, the Village was unsuccessful in its effort to rezone <br />approximately Three Hundred (300) acres of land within the <br />municipality which land is described in the legal description attached <br />hereto and marked Exhibit A, pursuant to Ordinance 72-33 enacted by <br />the Council of Mayfield Village, Ohio on October 17, 1977, said <br />Ordinance having been unconstitutional by the Court of Appeals of <br />Ohio, Eighth Appellate District (Cuyahoga County) in Consolidated Case <br />Nos. 915456, 916020, 916661 and 926138 from the Cuyahoga County Court <br />of Common Pleas; and <br />WHEREAS, since the date of the aforesaid opinion of the Court of <br />Appeals, the Allen-Bradley Co., the owner of certain property included <br />in the aforedescribed subject area, the Allen-Bradley Co. parcel being <br />more fully described in the legal description in Exhibits B-1 through <br />B-3 attached hereto and incorporated herein as if fully rewritten, <br />have submitted plans to the municipality for the proposed construction <br />of a corporate office facility on the approximate ninety (90) acres it <br />owns; and <br />WHEREAS, there have been no applications or presentation of plans <br />for the development of the remaining Two Hundred Ten (210) acres of <br />land in the subject area; and <br />WHEREAS, Council is desirous of studying the zoning of the <br />remaining land in the subject area;;, and <br />WHEREAS, the Council is desirous of employing the services of a <br />professional planning expert to assist it in its legislative <br />responsibility in studying zoning for the subject land; now, <br />therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD V ILLAGE, OHIO THAT: <br />Section 1. For the reasons set forth in the preamble <br />hereto, the Council of Mayfield Village, Ohio hereby proposes to study <br />the zoning of the land included in the legal description attached <br />hereto, marked Exhibit A and incorporated herein as if fully <br />rewritten, but excluding the land described in the legal descriptions <br />attached hereto, incorporated herein as if fully rewritten and marked <br />Exhibits B-1 through B-3. <br />_~ <br />
