ORDINANCE N0. 86- 21 <br />INTRODUCED BY: Council President Richard C. Etzler <br />AN ORDINANCE AUTHORIZING THE MAYOR TO INVITE BIDS <br />FOR RESPONSIBLE PROFESSIONAL PLANNING AND ZONING <br />CONSULTANTS TO PREPP,RE A THOROUGH AND COMPLETE <br />STUDY OF CERTAIN PROPERTY LOCATED WITHIN THE <br />MUNICIPALITY FOR THE PURPOSE OF DETERMINING THE <br />PROPER ZONING OF SAME, DECLARING A MORATORIUM ON <br />ANY CONSTRUCTION WITHIN THE AFFECTED AREA AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Council of Mayfield Village, Ohio, has placed <br />on first reading Ordinance No. 86-18 providing a procedure to rezone <br />certain property located within the municipality; and <br />WHEREAS, Ordinance No. 86-18 has been referred to the <br />Mayfield Village Planning & Zoning Commission for report and <br />recommendation pursuant to Article III, Section 12 of the Charter of <br />Mayfield Village, Ohio; and <br />WHEREAS, the Mayor and Council of Mayfield Village, Ohio <br />have determined, that in order to assist the Planning & Zoning <br />Commission and the Council in their respective functions concerning <br />the rezoning of the affected property, it would be beneficial to <br />retain the services of a professional planning and zoning consultant <br />to prepare a thorough and complete study of the proposed area to be <br />rezoned, together with a study concerning other non-residentially <br />zoned areas of the municipality and the community as a whole as it <br />affects the subject property to be rezoned; and <br />WHEREAS, the Allen-Bradley Company has submitted plans to <br />the municipality for the proposed construction of a corporate office <br />facility on approximately ninety (90) acres of land it owns in the <br />affected area; and <br />6VHEREAS, there have been no applications or presentation of <br />plans for the development of the remaining two hundred ten (210) acres <br />of land in the affected area; and <br />WHEREAS, the Council has determined that until it has <br />completed its legislative responsibility in considering the <br />appropriate zoning of the subject land, as set forth in Ordinance No. <br />86-18, no further plans or proposals for the development of the <br />remaining two hundred ten (210) acres shall be accepted by the munici- <br />pality nor shall any permits issue for the construction of any <br />improvements in the affected area so as to prevent the vesting of any <br />rights by the owners of the remaining parcels; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THATa <br />Section 1.
