ORDINANCE N0. 86- 21 INTRODUCED BY: Council President Richard C. Etzler AN ORDINANCE AUTHORIZING THE MAYOR TO INVITE BIDS FOR RESPONSIBLE PROFESSIONAL PLANNING AND ZONING CONSULTANTS TO PREPP,RE A THOROUGH AND COMPLETE STUDY OF CERTAIN PROPERTY LOCATED WITHIN THE MUNICIPALITY FOR THE PURPOSE OF DETERMINING THE PROPER ZONING OF SAME, DECLARING A MORATORIUM ON ANY CONSTRUCTION WITHIN THE AFFECTED AREA AND DECLARING AN EMERGENCY. WHEREAS, the Council of Mayfield Village, Ohio, has placed on first reading Ordinance No. 86-18 providing a procedure to rezone certain property located within the municipality; and WHEREAS, Ordinance No. 86-18 has been referred to the Mayfield Village Planning & Zoning Commission for report and recommendation pursuant to Article III, Section 12 of the Charter of Mayfield Village, Ohio; and WHEREAS, the Mayor and Council of Mayfield Village, Ohio have determined, that in order to assist the Planning & Zoning Commission and the Council in their respective functions concerning the rezoning of the affected property, it would be beneficial to retain the services of a professional planning and zoning consultant to prepare a thorough and complete study of the proposed area to be rezoned, together with a study concerning other non-residentially zoned areas of the municipality and the community as a whole as it affects the subject property to be rezoned; and WHEREAS, the Allen-Bradley Company has submitted plans to the municipality for the proposed construction of a corporate office facility on approximately ninety (90) acres of land it owns in the affected area; and 6VHEREAS, there have been no applications or presentation of plans for the development of the remaining two hundred ten (210) acres of land in the affected area; and WHEREAS, the Council has determined that until it has completed its legislative responsibility in considering the appropriate zoning of the subject land, as set forth in Ordinance No. 86-18, no further plans or proposals for the development of the remaining two hundred ten (210) acres shall be accepted by the munici- pality nor shall any permits issue for the construction of any improvements in the affected area so as to prevent the vesting of any rights by the owners of the remaining parcels; now, therefore, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THATa Section 1.
