O1/30/8N <br />ORDINANCE N0. 89-2 . <br />INTRODUCED BY: Mayor Carmen and the Entire Council <br />AN ORDINANCE <br />SUBMITTING TO THE ELECTORATS OF MAYFIELD VILLAGE, OHIO, <br />A PROPOSED A2SENIDMENT TO THE CHARTER OF THE VILLAG$ <br />PERMITTING THE VILLAGE COUNCIL TO MEET IN <br />PRIVATE ffiXECUTIVE SESSION, PROVIDING <br />FOR ALL NECESSARY PROCEDURBS IN CONNECTION HSREWITH <br />AND DECLARING AN ErERGENCY <br />WHEREAS, the existing Charter under Article X permits Council, by vote <br />of at least two-thirds (2/3) of its members, to propose any amendment to the <br />Charter for submission for approval of a majority of the electors voting <br />thereon; and <br />WHEREAS, the Mayfield Village Codified Ordinances allow Council to meet <br />in executive session solely for the purpose of discussing personnel matters, <br />matters of pending or imminent litigation and the buying or selling of real <br />estate, as provided in the Ohio Revised Code; and <br />WHSREAS, recent rulings of the Ohio Supreme Court have allowed Councils <br />to conduct such executive sessions when provided in the Municipal Charter; and <br />WHSREAS, without such ability to talk in private, the Village and its <br />taxpayers will be put at a disadvantage in all negotiations, legal matters and <br />personnel matters, where privacy will be necessary for the development of <br />strategy therein; and <br />WHSREAS, the Mayor and Council have determined that, in the best interest <br />of Mayfield Village, it is necessary to amend the Charter of Mayfield Village <br />to be consistent with the recent rulings of the Ohio Supreme Court; and <br />WHffitEAS, the next regularly scheduled Primary Election is to be held on <br />Tuesday, May 2, 1989, and any such issue must, therefore, be submitted to the <br />Cuyahoga County Board of Elections at least sixty (60) days prior thereto, <br />March 2, 1989. <br />NOW, THEItUORE, B$ IT ORDAINED BY THB COUNCIL OF MAYFIELD VILLAGE, OHIO, <br />THAT:
