RESOLUTION NO. 79- 78 <br />INTRODUCED BY: Council as a Whole <br />A RESOLUTION GRANTING A SPECIAL U-5 USE PERMIT <br />TO JEANNE MEYERS TO USE CERTAIN PREMISES FOR <br />AN AUTO BODY REPAIR SHOP AND TOWING SERVICE <br />FOR AUTOMOBILES FOR A PERIOD OF THREE (3) YEARS, <br />AND REPEALING RESOLUTION 79-39 <br />WHEREAS, this Council passed Resolution 79-39 on June 18, <br />1979, qranting to Jeanne Meyers a Special U-5 Use Permit; and <br />WHEREAS, following the passage of Resolution 79-39 there <br />followed discussions between the Permittee and Village officials <br />concerning certain of the fencing requirements contained therein; <br />and <br />WHEREAS, this Council has reconsidered its previous position <br />concerning those fencing requirements and has decided that less <br />stringent requirements will best benefit both the permittee and the <br />muncipality; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Council finds that the use of the property here- <br />inafter described as an auto body repair shop and towing service for <br />automobiles will substantially serve the public convenience and wel- <br />fare and will not substantially or permanently injure the appropriate <br />use of the neighboring property, and further that such use will not <br />be injurious, obnoxious or offensive by reason of emission of refuse <br />water, odors, dust, fumes, vibrations, smoke, gas, noise or other- <br />wise and will not be dangerous or harmful to life, health, property <br />or morals and will not cause undue congestion on the public highways. <br />Section 2, Council hereby modifies the permit and approval <br />granted by the Planning and Zoning Commission of Mayfield Village on <br />June 11, 1979, to Jeanne Meyers to operate an auto body repair shop <br />and towing service for automobiles as a Special U-5 use permit upon <br />the following described premises, subject to the conditions herein- <br />after set forth: <br />Situated in the Village of Mayfield, County of Cuyahoga, <br />and State of Ohio, and known as being a part of Original May- <br />field Township Lot No. 45, Tract No. 1, and bounded and <br />described as follows: <br />Beginning in the center line of S.O.M. Center Road at the <br />most Southeasterly corner of a parcel of land conveyed to Paul <br />Leo Schulz, January 13, 1933, and recorded in Volume 4285, <br />Page 27, of Cuyahoga County Deed Records. Thence due North <br />along the center line of S.O.M. Center Road 15 feet to a point. <br />Thence North 890 33' 22.5" West and parallel to Schulz's <br />southerly line a distance of 348 feet to a stone. Thence due <br />North a distance of 243 feet to an iron pipe stake set in a <br />southerly line of land conveyed to the State of Ohio by a deed <br />recorded in Volume 7863, Page 598, of Cuyahoga County Deed <br />Records.
