Ordinance No. 74- 19 <br />Introduced by: Mr. Prager <br />AN ORDINANCE TO AMEND ORDINANCE N0. 309, BEING AN ORDINANCE <br />TO REGULATE TRAFFIC ON THE STREETS AND PUBLIC HIGHWAYS OF <br />THE VILLAGE OF MAYFIELD BY AMENDING SECTION 19(g) OF <br />ORDINANCE N0. 810 PERTAIIQING TO SPEED REGULATIONS ON FREEWAYS <br />WITH PAVED SHOULDERS TO CONFORP4 WITH THE NATIONAL FUEL <br />CONSERVATION POLICY, AND TO DECLARE AN EIIERGENCY <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, CUYAHOGA COUNTY, <br />OHIO, THt1T: <br />Section 1. Section 19(g) of Ordinance No. 810, an Ordinance to regulate <br />traffic on the streets and public highways of the Village of Mayfield, is hereby <br />amended to read as follows: <br />"Section 19(g) <br />"(i) Sixty miles per hour at all times on freeways with paved shoulders <br />except fifty miles per hour at all times for operators of trucks <br />and commercial tractors weighing in excess of four thousand pounds <br />empty weight and school busses. <br />"(ii) It shall be prima-facie unlawful for any person to exceed any of the <br />speed limitations set forth in this section. In every charge of <br />violation of this section the Affidavit and Warrant shall specify <br />the time, place, and the speed at which the Defendant is alleged <br />to have driven, and also the speed which this section declares shall <br />be prima-facie lawful at the time and place of such alleged violation. <br />"(iii) Whenever the director of highways of the State <br />with Section 4511.21 of the Ohio Revised Code, <br />and prima-facie speed limit which is different <br />as set forth in this section, such speed limit <br />the Director of Highways sha11 be effective in <br />provided appropriate signs are posted giving ni <br />limitations. <br />of Ohio, in accordance <br />determines a reasonable <br />from any such limit <br />so established by <br />the Village of Mayfield, <br />)tice of such different <br />"(iv) Notwithstanding Section 19(g)(i) above, no person shall operate a <br />motor vehicle at a speed exceeding fifty-five miles per hour at all <br />times on freeways with paved shoulders inside the Village of Mayfield, <br />except fifty miles per hour at all times for operators of trucks and <br />commercial tractors weighing in excess of 4,000 lbs. empty weight, <br />and school busses. <br />"(v) Notwithstanding any other provisions of Section 14 of Ordinance No. 810 <br />of the Village of Mayfield relating to the prima-facie lawful operation <br />of a motor vehicle, the speed liciits established under Section 19(g)(iv) <br />of this Section shall be maximum lawful speeds, and no person shall <br />drive a vehicle at a speed in excess of such maximum limits.
