r ORDINANCE N0. 74-41 Introduced by: Mr. Schulte AN ORDINANCE TO AMEND ORDINANCE N0. 159, THE ZONING ORDINANCE OF THE VILLAGE OE MAYFIELD, BY ADDING SECTION 19.1 PERTAINING TO FENCES IN RESIDENTIAL DISTRICTS, REPEALING ORDINANCE N0. 773, AND DECLARING AN EMERGENCY WHEREAS, adequate provisions are not made in the present zoning ordinance to govern the height and type of fences in residential districts, and it is nec- essary to do so in order that owners of property in such districts will not be deprived of necessary light and air and in order that their property will not be depreciated in value by reason,:.of the presence of unsightly and unsafe fences on adjacent property; and WHEREAS, Council finds that this amending ordinance has been submitted to the Village Planning and Zoning Commission for approval, disapproval, or sug- gestions, and that said Coffiuission has allowed a reasonable time for consideration and report, and has approved the same in the form herein set forth, and that a public hearing has been had thereon, and notice of such hearing given in the man- ner govided by law. NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, COUNTY OF CUYAHOGA AND STATE OF OAIO, THAT: Section 1. Ordinance No. 159, the Zoning Ordinance of the Village of Mayfield, is hereby amended by adding thereto Section 19.1, which shall read as £ollows: "Sec. 19.1. Fences in Residential Districts. (a) In Front Yards. In front yards in Class U-1, U-2, U-3 and U-3 AA Use Districts, the only £ences permitted shall be open ornamental fences, which shall be placed adjacent to the front entrance of the dwelling, and not over 42 inches in height. An ornamental split rail fence may be placed at a point not closer than 12 inches from the front property line. (b) In Side and Rear Yards. In side yards and rear yards in Class U-1, U-2, U-3 AA Use Districts, the only fences permitted shall be as follows: Open fences not over 4? feet in height shall be permitted along the side line of rear yards and along the rear lot line, provided such fences shall have uniformly spaced openings aggre- gating 25% of their surface areas between residential properties.
