r <br />ORDINANCE N0. 74-41 <br />Introduced by: Mr. Schulte <br />AN ORDINANCE TO AMEND ORDINANCE N0. 159, THE <br />ZONING ORDINANCE OF THE VILLAGE OE MAYFIELD, BY <br />ADDING SECTION 19.1 PERTAINING TO FENCES IN <br />RESIDENTIAL DISTRICTS, REPEALING ORDINANCE N0. 773, <br />AND DECLARING AN EMERGENCY <br />WHEREAS, adequate provisions are not made in the present zoning ordinance <br />to govern the height and type of fences in residential districts, and it is nec- <br />essary to do so in order that owners of property in such districts will not be <br />deprived of necessary light and air and in order that their property will not be <br />depreciated in value by reason,:.of the presence of unsightly and unsafe fences <br />on adjacent property; and <br />WHEREAS, Council finds that this amending ordinance has been submitted <br />to the Village Planning and Zoning Commission for approval, disapproval, or sug- <br />gestions, and that said Coffiuission has allowed a reasonable time for consideration <br />and report, and has approved the same in the form herein set forth, and that a <br />public hearing has been had thereon, and notice of such hearing given in the man- <br />ner govided by law. <br />NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, <br />COUNTY OF CUYAHOGA AND STATE OF OAIO, THAT: <br />Section 1. Ordinance No. 159, the Zoning Ordinance of the Village of <br />Mayfield, is hereby amended by adding thereto Section 19.1, which shall read as <br />£ollows: <br />"Sec. 19.1. Fences in Residential Districts. <br />(a) In Front Yards. In front yards in Class U-1, U-2, U-3 and <br />U-3 AA Use Districts, the only £ences permitted shall be open <br />ornamental fences, which shall be placed adjacent to the front <br />entrance of the dwelling, and not over 42 inches in height. An <br />ornamental split rail fence may be placed at a point not closer <br />than 12 inches from the front property line. <br />(b) In Side and Rear Yards. In side yards and rear yards in <br />Class U-1, U-2, U-3 AA Use Districts, the only fences permitted <br />shall be as follows: <br />Open fences not over 4? feet in height shall be permitted <br />along the side line of rear yards and along the rear lot line, <br />provided such fences shall have uniformly spaced openings aggre- <br />gating 25% of their surface areas between residential properties. <br />[Provided, however, that an open or a closed fence not over eight <br />feet in height may be placed along the rear or side line which <br />separates residential property from property used for non-residential
