ORDINANCE NO. 73-12 <br />Introduced by: Mr. Davis <br />AN ORDINANCE PROVIDING FOR THE EMPLOYMENT <br />OF AN ENGINEER FOR THE VILLAGE OF bAYFIELD <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, <br />CUYAHOGA COUNTY, OHIO, THAT: <br />Sec. 1. Stephen Hovancsek is hereby employed and appointed <br />as Engineer for the Village of Mayfield until December 31, 1974, such <br />employment to be terminable by either the Village or said Engineer upon <br />90 days written notice to the other. However, all work, if same is <br />being processed in a manner satisfactory to the Village, shall be com- <br />pleted by the Engineer and the services therefor paid by the Village, <br />in accordance with the terms hereof. <br />Sec. 2. Said Stephen Hovancsek shall be compensated as fol- <br />lows, and the Mayor and the Clerk are hereby authorized to enter into <br />an Agreement in writing with said Stephen Hovancsek whereby he will be <br />paid on the following basis: <br />(a) If the proceedings for any improvement are completed <br />according to the usual schedule, as provided by law, so that the bids <br />are received and a contract is awarded, he shall be paid a sum equal to <br />seventy-five percent (750) of the amount listed in Sec. 2(b); as the <br />work progresses, he shall receive additional compensation equal to the <br />balance of the fee listed in Sec. 2(b); said sum to be paid at the time <br />the contractor's estimates, upon which his payment is based, are pre- <br />sented for payment. Before the final estimate for the work is issued, <br />any adjustment shall then be made so that the total fee paid him shall <br />be equal to the percentages listed in Sec. 2(b). <br />(b) That for such services in connection with construc- <br />tion of public improvements, he shall receive compensation on a per- <br />centage for the actual cost of construction of all improvements made by <br />Council or under their control.
