ORDINANCE NO. '73-39 <br />Introduced by: Bordonaro <br />AN ORDINANCE TO REGULATE THE USE, STORAGE AND <br />TRANSPORTATION OF EXPLOSIVES FOR BLASTING PURPOSES <br />AND PYROTECHNIC DISPLAYS AND REPEALING ORDINANCE <br />NO. 69-25 <br />BE IT ORDAINED BY TIIE COUNCIL OF THE VILLAGE OF HAYFIELD, <br />CUYAHOGA COUNTY, OHIO, TIiAT: <br />Section 1. It shall be unlawful for any person, firm or <br />corporation to blast with dynamite, gun powder or any other explosive <br />compound, within the limits of the Village of Mayfield, Ohio, unless <br />there first shall have been issued a written permit from the Village <br />Engineer. Said permit shall set forth the conditions and the circum- <br />stances under which said blasting may be done. The fee far such <br />permit shall be Ten Dollars ($10.00), and said permit shall be for <br />such period as the Village Engineer may designate, but not for over <br />sixty (60) days; the permit may be renewed by the Village Engineer <br />for an additional period of sixty (60) days without payment of additional <br />fee. <br />Section 2. Before a permit to do blasting shall be issued, <br />the applicant for such permit shall file a liability insurance policy <br />in the sum of One Hundred Thousand Dollars ($100,000.00) for any one <br />individual, and Three Hundred Thousand Dollars ($300,000.00) for any <br />accident, covering bodily injury, and wrongful death, and in the amount <br />of Fifty Thousand Dollars ($50,000.00) insuring against property damage <br />of any nature caused by such blasting. Such policy shall be approved <br />by the Solicitor of the Village, and the policy or copy thereof shall <br />be filed with the Clerk-Treasurer. Said policy shall name the Village <br />of Payfield as an additional insured. <br />Section 3. The Village Engineer shall supply an Inspector <br />who shall supervise all drilling, charging and shooting of all holes; <br />who shall not be required by the contractor to work less than six (6) <br />ours in any one day. <br />Section 4. Blasting operations shall not be conducted <br />between the hours of 7:00 o'clock p.m. and 7:00 o'clock a.m., nor at <br />any time on Sundays except by special permission of the Chief of Police. <br />Section 5. At least twenty-four (24) hours in advance of <br />blasting, the blaster shall give written notice specifying the location <br />and intended time of blasting to the appropriate representatives of the <br />gas, electric, water, telephone, telegraph and steam utilities which <br />operate within the municipality. In an emergency, the Village Engineer <br />may waive the time limit and allow verbal instead of written notice <br />to be given. <br />
