~r <br />ORDINANCE N0. 1072 <br />BY: PIIt. COMELLA <br />AN ORDINANCE PROVIDING FOR THE ESTABLISHING, SETTING AND <br />CHECKING OF GRADES OF ALL BUILDINGS AND FEES THEREFOR. <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, COUNTY OF <br />CUYAHOGA, OHIO, THAT: <br />Section 1. The Building Inspector shall, before issuing any permit <br />for construction involving excavation, grading, filii.ng or hauling of earth <br />to or from the site of such construction, collect from the applicant for such <br />permit, the following amounts (unless the Building Inspector and Engineer <br />hereinafter designated, agree upon different amounts) in the following cases, <br />which shall go into a general fund of the Village, to be paid to the Engineer <br />hereinafter designated: <br />;r <br />(a) Single and two-family residential buildings, $35.00; <br />(b) All other residential buildings and commercial and <br />industrial buildings, $10.00 per 1,000 square feet <br />of floor space, counting all floors - minimum fee <br />$50.00; maximum fee $300.00. <br />The Building Inspector shall also collect from the ap- <br />plicant the sum of $5.00 to pay for the services rendered by the Village. <br />Section 2. In each case of new construction, the Building Inspector <br />shall designate the Village Engineer, or any other competent licensed engineer, <br />to establish, set and check the grades for such property. <br />Section 3. In establishment, setting and checking of grades in set- <br />back lines, the Engineer shall consider the natural topography of the property <br />upon which construction is intended, the finished grades of adjoining premises, <br />the location of public utilities in relation to the premises being improved, <br />the contemplated use of the premises being improved, the contemplated use of <br />the premises and the uses permitted of undeveloped adjoining properties, if <br />any, under applicable zoning regulations. Any person dissatisfied faith the <br />grade finally established or set by the Engineer, may, within .ten days, file <br />a Notice of Appeal, in writing, to the Architectural Board of Review of the <br />Vilhge of Mayfield, which shall consider the criteria required to be observed <br />by the Engineer, as hereinabove set forth, accord a hearing to all interested <br />parties, including land owners, and may affirm or modify the Engineer's deter- <br />mination. The order of the Architectural Board of Review may be appealed <br />within ten days to the Council, by filing written notice with the Clerk-Treasurer. <br />Section 4. After the lot and all buildings thereon are surveyed and <br />staked, the owner or builder shall give at least 24 hours notice to the Building <br />Inspector that the grade is ready to be set by the Engineer.
