icy <br />ORDINANCE N0. 69 - 34 <br />BY: MR. FIT7-GERALD <br />AN ORDINANCE PROVIDING FOR THE DESTRUCTION OF NOXIOUS <br />WEEDS GROWING WITHIN THE VILLAGE OF HAYFIELD AND <br />REPEALING ORDINANCE N0. 1010. <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA <br />COUNTY, OHIO, THAT: <br />Sec. 1. Upon the filing with the Chief of Police of a written <br />complaint by a resident of or owner of land situated in the Village of Mayfield <br />that noxious weeds, grass or other deleterious growths over 12" in height are <br />growing on any land within the Village within 300 feet hack from the traveled <br />portion of any public or private street or highway or within 150 feet of any <br />residential, commercial, or industrial building, or of any school, church, <br />cemetery, or other building used for public or philantropic purposes, the <br />Chief of Police or any other police officer shall serve written notice upon the <br />owner, lessee, agent, tenant, or other person having charge of such land, <br />notifying him that such noxious weeds, grass, or other deleterious growths must <br />be cut and destroyed within 5 days after the date of said notice. Said notice <br />may be served personally or by leaving it at the usual place of residence of the <br />person to be notified, whether his place of residence be within the Village of <br />Mayfield or not, or may be served by certified mail addressed to his last known <br />place of residence or to the place where his tax bills are sent. If the address <br />of the person to be so notified is unknown or if service cannot be otherwise <br />obtained, it shall be sufficient to publish such notice once in a newspaper of <br />general circulation in the Village of Mayfield. Said notice shall also advise <br />the person served with the same that, if he fails to comply with the notice <br />within the time required thereby, the Chief of Police will cause such noxious <br />weeds to be cut and destroyed and will employ the necessary labor to perform <br />such task, and that the person so served will be required to pay to the Village, <br />not only the amount payed out by the Village for such labor, but in addition a <br />fee to the Village for services hereunder, which service fee shall be thirty <br />(30) percent of the cost of employing such labor, but in no event shall service <br />fee be less than $25.00. <br />Sec. 2. The fees for service of the notice shall be the same as are <br />allowed for service and return of service in civil cases in the Lyndhurst <br />Pfunicipal Court. <br />Sec. 3. If the owner, lessee, agent or tenant having charge of the <br />lands mentioned in Section 1 of this Ordinance fails to comply with the notice <br />required by said section, Council hereby authorizes the Chief of Police to cause <br />such noxious weeds to be cut and destroyed and to employ the necessary labor to <br />perform such task.
