OBDINANCE No. 932 <br />By Mr. Sloan <br />AN ORDINANCE PROVIDING FOR THE E1,1PL03CIyfENT OF <br />AN EP1GjNEER FOR THE VILI.AGE, OF MAYFIII.D _ <br />BE IT ORDAINED BY THE COUNCIL OF THE VILI,AGE OF MAYFIELD, CUYAHOGA COUNTY, <br />OHIO, THAT: <br />Sec. 1. Harold P. Peterson is hereby employed attd appointed as <br />Engineer for the_Village of Mayfield until December 31st, 1967, such employ- <br />ment to be terminable by either the Village.or said Engineer upon 90 days' <br />written notice to the other. However, all work, if same is being processed <br />in a manner satisfactory to the Village shall be completed by the ENGINEER <br />and the services therefor paid by the VILI,AGE in accordance with the terms <br />hereof. <br />Sec. 2. Said Harold P. Peterson shall be compensated as follows, and <br />the Mayor and Clerk are hereby authorized to enter into an Agreement in <br />writittg with said Harold P. Peterson, whereby he will be paid on the following <br />basis: <br />Sec. 2a. For Improvements: 8% of the first $25,000.00 or less of the <br />accepted bid; 7%,,of the next $25,000,.00 or less of the accepted bid; 6% of <br />the amount over $50,000.00 of the'accepted bid; if the proceedings for any <br />improvements are,completed according to the usual schedule, as provided by law, <br />so that the bids are received and a contract is awarded, he shall be paid a <br />sum equal to seventy-five percent (75%) of the amount listed above; the <br />remainder-to be paid at the time the contractorts estimates upon which his <br />payment is based, are presented for payment. Before the final estimate for <br />the work is issued, any adjustment shall then be made so that the total fee <br />paid him shall be equal to the percentages listed above. <br />Sec. 2b. If after the plans, profiles, specifications and estimates <br />of costs for work_authorized and approved by the Council have been prepared <br />by the SNGINEER, the proceedings for such work is abandoned, or is postponed <br />for a period of more than six (6) months, or the actual construction of such <br />work is not commenced within nine (9) months after the date of delivery of <br />said plans, profiles, specifications and estimates of cost, then he shall be <br />paid forthwith a sum equal to seventy-five percent (75%) of the fee stated in <br />Paragraph 2a, based on the total estimated cost of said_improvements, as full <br />compettsation for all work done up to that date upon the project in question. <br />
