s~~~ <br />SPECIAL COUNCIL MEETING <br />Village of Mayfield Village <br />October 25, 1977 <br />The Council of Mayfield Village met in special sess-~~on on Tuesday, <br />October 25, 1977 at 8:30 P.M.o pursuant to Special Meeting notices <br />delivered to Council on October 21, 1977. President, Robert Grogan <br />presided. <br />Roll Call: Present: Messrs., Barclay, Bennett, Bordonaro, Busa, <br />Flynn, Grogan and Schulte <br />Absent: None <br />Also present were Mayor Beebe, Messrs., Amendola, Hovanscek and <br />Relic <br />Mr. Grogan stated the purpose of this meeting was to confirm the <br />Mayor's appointment of a new Law Director. <br />Mayor Beebe read the duties of the Law Director as stated in the Charter. <br />He also read portions of Mr. Avery's letter dated 9-21-77 to the Mayor <br />outlinging his fees and duties. He said Council had been advised of his <br />choice for a new Law Director, that-being, Guerin L. Avery Co., L.P.A., <br />13880 Cedar Road, University Heights, Ohio 44118. Mayor Beebe recom- <br />mended to Council the appointment of Mr. Avery and consider a hiring <br />date of November 15, 1977 through December, 1978. <br />Mr. Grogan said that he had personally talked to Mr. Avery on the <br />phone on several matters regarding deletion of charges for secretary <br />fees, parking fees and travel. NIr. Avery agreed verbally. Mr. Grogan <br />suggested that Mr. Avery be appointed as of November 1, 1977 until the <br />Organizational Meeting in January, 1978 with the same terms. He thought <br />it would be more fair if the new Council confirmed the appointment for <br />1978. Mr. Grogan distributed a copy of the motion he had written to <br />Council: <br />Mr. Grogan, seconded by Mr. Bordonaro, made a motion to confirm the <br />Mayor's appointment of Guerin L. Avery as Law Director for Mayfield <br />Village, Ohio, effective no later than November 1, 1977, and for a <br />term ending at the Council Organizational Meeting of January, 1978. <br />Said confirmation shall be subject to the following condi:cions: <br />1. That all presently pending law suits involving the Village, <br />including those on appeal, shall be turned over to Mr. Avery. <br />2. That the contract~,~wi:thc<<P~r~. Avery and his firm shall include a <br />retainer of One Thousand Dollars ($1,000.00) per month and a <br />charge of Fifty Dollars ($50.00) per hour for actual physical <br />attendance at court, arbitration or depositions, subject to a <br />maximum of Three Hundred Dollars ($300.00) per day. All such <br />charges are to be itemized by time to the quarter hour. In <br />addition thereto, the Law Director shall be reimbursed for <br />travel outside Cuyahoga County, long distance telephone charges <br />and registered and certified mail charges incurred on behalf of <br />the Village. <br />
