<br />"~ ~ MINUTES OF A SPECIAL MEETING OF COUNCIL <br />Mayfield Village <br />September 29, 2003 <br />The Council of Mayfield Village met in special session on Monday, September 29, 2003, at <br />6:00 p.m. in the Mayfield Village Senior Center/Community Room. Council President Bill <br />Buckholtz presided. <br />ROLL CALL: Present: Mr. Buckholtz, Mrs. Cinco, Mr. Marquardt, Mr. Marrie, <br />Mrs. Mills and Mr. Riter <br />Absent: Mayor Rinker and Dr. Parker <br />Also Present: Mr. Brett, Ms. Calta, Mrs. Garbo and Mrs. Roman <br />First Reading of Ordinance No. 2003-34, "An emergency ordinance authorizing a contract <br />with Moderalli Excavating for the furnishing and installation of all labor, equipment, materials, <br />appurtenances and incidentals required to perform the riparian restoration for the Upper Forty <br />area." Introduced by Mayor Rinker and Council as a Whole. <br />Mrs. Cinco, seconded by Mr. Marquardt, made a motion to suspend the rules of Council <br />requiring an ordinance to be read on three separate occasions. <br />Roll Call: AYES: All <br />NAYS: None Motion Carried <br />Rules Suspended <br />Mrs. Cinco, seconded by Mr. Marquardt, made ~a motion to enact Ordinance No. 2003-34. <br />Council President Buckholtz asked Ms. Calta to update everyone. <br />Ms. Calta explained that bids were opened on Thursday and URS recommended that King <br />Excavating was the lowest and most responsive bidder. I believe Donna received a phone call <br />and a fax [letter] that King Excavating would be withdrawing their bid stating that they had made <br />a math error in their bid. I am sure everyone noticed their bid was about half what the second <br />lowest bidder bid. According to Ohio statute, if the lowest bidder comes in and is substantially <br />lower than any others and he represents that there's been a mathematical error he can withdraw <br />his bid (which is what he is doing) so long as he provides notice to the Village. So that bid has <br />been withdrawn. URS provided to me today a letter recommending the next lowest bidder being <br />Moderalli Excavating. They indicated in their letter that they are doing work with Moderalli in <br />another municipality in Canton, Ohio and they are recommending them as they have been <br />progressing properly with that project and they have no reason to believe that they wouldn't be <br />able to fulfill the terms of this contract. <br />1 <br />~'' Mr. Marrie asked if we brought it to King's attention or did King bring it to our attention? <br />
